A. 
For purposes of this chapter, the following terms, phrases and words shall have the meanings set out herein:
ADMISSION CHARGE
Any charge or money collected for the right or privilege to any entertainment or amusement or dancing; all charges made for the use of facilities for the purposes of entertainment or amusement or dancing.
LICENSEE
A person having a license from the Borough of Cheswick in full force and effect issued hereunder for a public dance hall.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
PUBLIC DANCE
Any dance in which the public generally may participate, either with or without the payment of a fee, wardrobe charge or otherwise.
PUBLIC DANCE HALL
Any room, space or place in which dancing is carried on and which is open to the public generally and to which admission may be had, either or without the payment of a fee, wardrobe charge or otherwise.
B. 
Word usage. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number.
No person shall construct, operate or maintain a public dance hall within the Borough of Cheswick without first obtaining a license as hereinafter provided from the Mayor of the Borough of Cheswick.
Application for licenses issued hereunder shall be made upon blank forms prepared and made available by the Borough Secretary and shall state:
A. 
The name, home address and proposed business address of the applicant; if the applicant is a corporation, then the names and addresses of officers and directors of said corporation.
B. 
The number of people the public dance hall is designated to accommodate.
C. 
The names, addresses and number of employees and attendants.
D. 
Drawing. An application hereunder shall be accompanied by a drawing of said public dance hall, showing its location, size and capacity, location and size of all entrances and exits and fire and emergency exits, location and size of all structures and internal walls and partitions.
E. 
Such other information as the Mayor shall find reasonably necessary to effectuate the purposes of this chapter and to arrive at a fair determination of whether the terms of this chapter have been complied with.

An application hereunder shall be accompanied by an application fee as included in a schedule of fees adopted and amended from time to time by resolution of the Borough Council.

Within 21 days after receipt of an application as provided for herein, the Borough Secretary shall cause an investigation to be made of the applicant and the applicant's proposed public dance hall operation and shall report the findings to the Mayor.
The Mayor of the Borough of Cheswick shall issue a license hereunder when he finds that:
A. 
The applicant and all employees and attendants are of good moral character and capable of operating the proposed business in a manner consistent with the public safety and general welfare.
B. 
The requirements of this chapter and of all other governing laws and ordinances have been met.

A license shall be issued to a successful applicant hereunder after payment to the Mayor of the Borough of Cheswick of an annual license fee as included in a schedule of fees adopted and amended from time to time by resolution of the Borough Council. The annual fee is to be paid by January 31 of each succeeding year after the license has been issued under § 85-6.
A licensee hereunder shall comply with the following requirements and standards of operation:
A. 
The licensee shall maintain good order upon the premises where any public dance hall is operated, and loitering shall not be permitted in or about the entrance to or exits from such public dance hall.
B. 
Hours of operation. The licensee shall not conduct any public dance hall before the hour of 8:00 p.m. or after the hour of 12:00 midnight, Monday through Sunday.

C. 
Fire exits. The licensee shall maintain all fire exit doors unlocked during the hours of operation.
The Mayor shall have the authority to revoke or suspend a license issued hereunder when he finds that:
A. 
The licensee is operating in violation of this chapter or any other governing law, ordinance or regulation.
B. 
The licensee is operating so as to constitute a nuisance by reason of noise or immoral or illegal activity on the premises.

In addition to the revocation of a license as provided for in § 85-9, any person violating any of the provisions of this chapter shall be punishable, upon conviction thereof, by a fine of not less than $50 nor more than $600, and costs of prosecution, for each offense or, upon default in payment of the fine and costs, by imprisonment in the county jail for not more than 30 days.
