As used in this article, the following terms shall have the meanings indicated:
HOUSEHOLD PET
A domesticated animal that is normally or generally kept within the immediate living quarters of a residential structure. Any member of the sheep, swine, poultry, bovine or equine family of quadrupeds or reptiles having a venomous or constrictor nature does not constitute a household pet under this article.
A. 
Except as provided in § 88-37 of this article, after the date of enactment of this article it shall be unlawful for any person, partnership, association, firm or corporation to keep, maintain or have in its possession or control within the Borough of Cheswick any poisonous reptile or other dangerous or carnivorous wild animal or reptile or any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities or any animal as provided in § 88-35B of this article or any animal other than a household pet.
B. 
Except as provided in § 88-37 of this article, after the date of enactment of this article it shall be unlawful for any person, partnership, association, firm or corporation to keep, maintain or have in its possession or control or under its possession or control within the Borough of Cheswick any of the following animals: all poisonous reptiles, including rear-fang snakes, apes, gibbons, gorillas, orangutans and siamangs, baboons, boars, bison, cheetahs, crocodiles, constrictor snakes, coyotes, deer, including whitetail deer, elk, antelope and moose, elephants, gamecocks and other fighting birds, hippopotamuses, hyenas, jaguars, leopards, lions, lynxes, ostriches, pumas, rhinoceroses, snow leopards, swine, tigers and wolves.
The provisions of this article shall not apply to licensed pet shops or zoological gardens and circuses if the location of such activities, businesses or enterprises conforms to the provisions of the Zoning Ordinance of the Borough of Cheswick,[1] all animals identified above are kept in a clean and sanitary environment and so maintained as to eliminate objectionable odors and animals identified above are maintained in quarters constructed to prevent escape.

It shall not be a violation of this article after the date of enactment of this article for any person, partnership, association, firm or corporation to keep, maintain or have in its possession or control or under its possession or control within the Borough of Cheswick any animal otherwise prohibited by this article if:
A. 
The animal was housed, kept or otherwise maintained within the Borough of Cheswick prior to the date of enactment of this article;
B. 
The person, partnership, association or corporation acquired the animal in conformity with applicable federal, state and/or municipal statutes and/or regulations;
C. 
The person, partnership, association or corporation that acquired the animal has documented proof, in the form of a receipt or similar document, of such acquisition prior to the effective date of this article;
D. 
The person, partnership, association or corporation that acquired the animal has provided of the documented proof described in Subsection C above and has registered the animal with the Borough on a form to be approved by the Borough Secretary; and
E. 
The animal is maintained as required by § 88-36 of this article.
Any person, partnership, association, firm or corporation who or which shall violate the provisions of this article, upon conviction thereof in a summary proceeding, shall be sentenced to pay a fine of not more than $1,000. Each day that this article is not complied with shall be a separate violation.
