[1943 Code § 303.03]
For the purposes of this chapter the following words and phrases shall have the meanings respectively ascribed to them by this section:
AUTOMOBILE DEALER
Any building, structure, premises, vacant lot, enclosure or other places within the Village, where the business of dealing in new or secondhand automobiles, auto cars, or any motor trucks or any similar self-propelled vehicles, or any of the parts or accessories thereof, is conducted or carried on; provided, that any place where secondhand automobiles are repaired or altered in any way, in case the same are taken off the public thoroughfare and driven into such place for that purpose only, shall not be deemed to be an automobile dealer under this chapter.
AUTOMOBILE REPAIR SHOP
Includes any store, room, place or establishment where secondhand cars are repaired or altered in any way, in case the same are taken off the public thoroughfare and driven into such place for that purpose only.
TIRE REPAIR SHOP
Includes any store, room, place or establishment where the business of repairing automobile tires, or of selling storage batteries or recharging storage batteries is carried on.

The application for a license for the business of managing, conducting, operating or carrying on the business of automobile dealer, automobile repair shop or tire repair shop shall be in writing and shall contain, if an individual, his name and address and the trade name, if a partnership, the name and address of each of the copartners, and if a corporation, the name and address of the officers of such corporation. Such application shall specifically describe the location of the building, structure, premises, lot or enclosure in or on which it is proposed to establish the business known as automobile dealer; and if such business is located in a building or structure, the construction of such building, number of square feet of floor area in such building or structure and the number of employees or persons engaged or employed therein. The President shall cause such building, structure, premises, lot or enclosure to be inspected by the fire marshal, whose duty it shall be to transmit to the President all facts and circumstances connected with such building, structure, premises, lot or enclosure, and the President shall submit such application to the President and Board of Trustees for their approval and if approved by them, upon payment of the fee or fees as required by Section 29-11 of this Code, the clerk shall issue a license for the conduct of such business.

No license shall be issued to any person to carry on the business of buying, selling or dealing in new or used motor vehicles or parts thereof unless such businesses are conducted within an improved building and enclosure and such building conforms with the general requirements of this Code relating to buildings and all such places shall be free from the effluvia of a sewer, drain, privy or other nuisance, also free as far as practicable from all gases, vapors, dust or other impurities generated by the operation of motors or other machinery, or otherwise, which are injurious to health, sufficient and separate water closets shall be provided for male and female employees and such water closets compartments shall be properly ventilated, the department of health and human services shall inspect all such places as often as it shall deem necessary to see that the provisions of this section are complied with; provided, however, that under no circumstances shall the business of buying, selling or dealing in used motor vehicles or parts thereof, whether in an enclosed building or otherwise, be conducted in the Village unless it is used in connection with a bona fide establishment selling new cars and having a franchise to sell new cars, and then in such event, the business of the selling of new cars and used cars shall be conducted and the vehicles shall be kept and exhibited within the confines of a building, which building must comply with all the ordinances of the Village.

No automobile dealer or automobile repair shop shall purchase from any person any catalytic converter that is not attached to a motor vehicle, or any portion of a dismantled catalytic converter that is reasonably identifiable as such, unless the person from whom such catalytic converter or portion thereof is purchased is: a) another properly licensed automobile dealer or automobile repair shop under this chapter, or b) a properly permitted recycling facility, or c) the original manufacturer of the catalytic converter or portion thereof.

Catalytic converters or parts of dismantled catalytic converters shall only be sold, disposed of or otherwise transferred: a) to another properly licensed automobile dealer or automobile repair shop under this chapter, or b) to a properly permitted recycling facility, or c) by returning the converter or part thereof to its original manufacturer. Each catalytic converter or part thereof that is sold, disposed of or otherwise transferred pursuant to this section shall be accompanied by a dated invoice, which shall be prepared for each catalytic converter that is removed from a vehicle. Such invoice shall include the full name, address, telephone number and driver's license member of the owner of the vehicle from which the catalytic converter was removed, and the make, model, year and vehicle identification number of such vehicle. Such invoices shall be kept by the licensee for two years and, upon request by any authorized Village official, shall be made available for inspection during the shop's regular business hours by such authorized Village official.
