For the purposes of this chapter:
PRIVATE SWIMMING POOL
A swimming pool which is used exclusively by the occupants of the property on which it is located, his family and guests.
SWIMMING POOL
A man-made rigid or semirigid receptacle for water having a depth at any point greater than 18 inches, used or intended to be used for swimming, wading or bathing, and constructed, installed or maintained in or above the ground, and if entirely within an enclosed building shall be designated as an indoor swimming pool and, if not, it shall be known as an outdoor pool.

No person shall hereafter construct, cause to be constructed, operate or maintain a swimming, wading or bathing pool without first obtaining a permit therefor from the Village. Written application for such permit shall be filed with the building commissioner and shall be accompanied by two sets of plans and specifications sufficiently detailed to enable determination of whether the proposed pool complies with the requirements of this chapter. No such permit for an existing pool shall be granted by the building commissioner until full compliance with this chapter has been demonstrated.

The fees for a permit for the erection or construction of a swimming pool shall be $25 for all pools.

Every person in possession of land on which an inground swimming, wading or bathing pool is situated, or will be built, shall conform with the following regulations.
(a) 
Water Supply, Etc. No source of water, other than that secured from the Village waterworks distribution system, shall be used in private swimming pools. The connection shall be, as required by the plumbing code, by means of a permanent, rigid system of piping having an air gap, delivery connection located not less than six inches vertically above the flood rim of the pool.
No swimming, wading or bathing pool in excess of 2,500 gallon capacity shall be installed or operated without a recirculating and filtering system.
(b) 
Outlets. In swimming pools, 30 feet in width or less, water circulation system outlets shall be located so as to provide at least one outlet at the deepest point in the pool. If the pool width is more than 30 feet, multiple outlets shall be provided and spaced not more than 30 feet apart, nor closer than four feet to any wall. All pool drain outlets shall be equipped with gratings having an area of opening of not less than four times the cross sectional area of the outlets pipe. The gratings shall be of such design so they cannot be readily removable by bathers and will not injure bathers' fingers. One outlet shall be provided for each 800 square feet of surface area.
Pools shall be equipped with facilities for completely emptying the pool and the discharge of the pool water to the sewer shall be at the rate not exceeding 250 gallons per minute. No direct connection shall be made to the sewer.
Water drained from the pool shall not be discharged to the sewer system during periods of rain or storms.
(c) 
Structural Design. Residential swimming pools shall be designed to withstand water pressure from within and to resist pressure of the earth when the pool is empty, to a pressure of 2,200 pounds per square foot. Materials used shall be subject to the approval of the building commissioner.
(d) 
Walk Areas. Unobstructed walk areas not less than 36 inches wide shall be provided to extend entirely around the pool. The walk area shall be constructed of impervious material, and the surfaces shall be of such as to be smooth and easily cleaned and of nonslip construction.
The slope of the walks shall have a pitch of at least 1/4 inch to the foot, designed so as to prevent back drainage from entering the pool.
(e) 
Steps or Ladders. Two or more means of egress in the form of steps or ladders shall be provided for all private residential swimming pools. At least one such means of egress shall be located on a side of the pool at both the deep end and shallow end of the pool. Treads of steps and ladders shall be constructed of nonslip material and at least three inches wide for their full length. Steps and ladders shall have a handrail on both sides.
(f) 
Electrical Requirements. All electrical installations provided for, installed and used in conjunction with private residential swimming pools, shall be in conformance with the provisions of the electrical code of the Village. No current carrying electrical conductors shall cross private outdoor residential swimming pools either overhead or underground or within 15 feet of such pools.
All metal fences, enclosures or railings near or adjacent to private outdoor residential swimming pools, which might become electrically alive as a result of contact with broken overhead conductors, or from any other cause, shall be effectively grounded.
(g) 
Presence of Skilled Swimmer. A skilled swimmer shall be present at all times that private residential swimming pools are in use.
(h) 
Cover. A suitable substantial protective cover shall be provided and installed over all private outdoor residential swimming pool surfaces during the nonswimming season or when residents are absent for a period of more than three days.
(i) 
Sanitation. Every pool shall be so designed and constructed as to facilitate cleaning and shall be maintained and operated in such manner as to be clean and sanitary at all times.

Outdoor swimming pools shall be located in the rear yard and are not permitted in any front yard or corner side yard. Swimming pools shall be set back at least 10 feet from the main structure and a minimum five feet from the rear lot line and shall be located not less than five feet from any auxiliary building. Swimming pools shall be set back at least two feet from the side lot lines for lots which are less than 40 feet wide, and at least three feet from the side lot lines for lots which are 40 feet wide or greater. No swimming pool shall be constructed so as to encroach into any easement. Pumps, filters and pool water disinfecting equipment installation shall be located at a distance not less than eight feet from any side property line. In the event of a conflict between this section and the provisions of Section 47-4 of this article, which regulates inground swimming pools, the provisions of Section 47-4 of this article shall control.

Every person in possession of land within the Village, either as owner, purchaser under contract, lessee, tenant, or licensee, upon which is situated an outdoor swimming pool, shall at all times maintain on the lot or premises upon which such pool is located and completely surrounding such pool, a fence or other structure to prevent small children from inadvertently wandering into the pool. Such fence or other structure shall be not less than five feet nor more than six feet in height with no gaps or apertures, other than doors or gates, more than four inches square, such fence shall be erected along the periphery of the pool walks. All gates or doors opening through such enclosure shall be equipped with a self-closing and self- latching device designed to keep and capable of keeping such door or gate securely closed and locked at all times when not in actual use to prevent small children from opening such door or gate; provided, however, that the provision of this section shall not apply to indoor swimming pools.

Where a swimming pool has a diving board or diving apparatus for the purpose of diving into the pool, there shall be a clear area of not less than an eight foot radius ahead of the furthermost projection of the diving board.

Every existing private residential swimming pool and every such pool constructed, installed and maintained hereafter shall comply with all applicable provisions of this chapter, and with all the provisions of the building ordinances and codes of the Village.
Swimming pools in existence on the effective date of this chapter shall be brought into compliance with the requirements of this chapter on or before July 1, 1961.

The building commissioner is charged with the duty of enforcing this chapter. For this purpose he is hereby authorized to enter upon any premises in the Village to investigate the existence of a swimming pool and to determine whether or not any such pool complies with the requirements of this chapter.

No person or persons shall enter into or use any outdoor swimming pool located within the Village at any time, other than between the hours of 8:00 a.m. and 10:00 p.m., except on Saturdays, at which time no person or persons shall enter into or use any outdoor swimming pool located within the Village at any time other than between the hours of 8:00 a.m. and 12:00 midnight, and any person or persons violating this section shall be fined not less than $10 nor more than $500 for each violation.
