[1943 Code § 332.01]
The term "retail" as used in this chapter shall be construed
to mean any transfer of the ownership of, or title to, tangible personal
property for use or consumption, and not for resale in any form as
tangible personal property.

No person, not otherwise licensed, shall conduct what is commonly known as a department store, general store, variety store, $0.5 and $0.10 store, haberdashery, dry goods store or other "retail" merchandise store, at "retail," as defined in Section
42-1 of this chapter without first having obtained a license therefor, as provided in this chapter.

For the purpose of this chapter, each of the businesses mentioned in the preceding section shall be licensed as a retail merchandise store, and every person desiring to engage in such business shall make application to the Village Clerk, which shall conform to the general provisions of Chapter
29 of this Code relating to application for licenses, and shall set forth a description of the premises, as well as the location of the same.

Every retail merchandise store shall be kept in a clean and
sanitary condition. All necessary measures shall be taken to safeguard
the lives and health of all persons employed in such establishments,
and adequate and convenient washing and toilet facilities shall be
provided for such employees.

The commissioner of health shall have the right to cause an
investigation to be made of the premises named and described in the
application for a license to conduct a retail merchandise store for
the purpose of determining the fitness and suitability of such premises
for such business from a sanitary standpoint and determining whether
or not the premises comply with all the ordinances of the Village
and the laws of the state regulating health, safety and sanitation
so as to properly safeguard the lives and health of the employees
engaged therein. If the report of the commissioner of health, when
transmitted to the President and Board of Trustees, shall indicate
that the person has not complied with such laws or ordinances, then
the President and Board of Trustees may revoke any license granted
hereunder.

(a) It shall be unlawful for retail merchandise stores to open for business
earlier than 5:00 a.m. on a daily basis.
(b) Retail merchandise stores shall close no later than 11:00 p.m. on
a daily basis.
(c) Such hours of operation shall apply to all sales and delivery activities
of retail merchandise stores.
(d) No retail merchandise store shall permit any person other than an
operator or its employees to remain in or on the premises of such
retail merchandise store longer than 30 minutes after the closing
hour or 30 minutes prior to the opening hour of such establishment.
