The location, construction and maintenance of driveways shall
be under the direction and supervision of the Village Engineer and
the location and construction of the same shall be in accordance with
the plans and specifications as approved by the engineer.

No person shall hereafter construct, build, establish or maintain
any driveway over, across or upon any public sidewalk or public parkway
where such driveway is for other than residence or dwelling house
use, or where it is necessary to cut down or alter any street curb
or where the driveway depresses or elevates the established grade
of public sidewalks or parkways, without first obtaining an order
so to do from the President and Board of Trustees and a permit so
to do as hereinafter provided.

A driveway over sidewalk space which does not elevate or depress
the existing grade of sidewalks and parkways and which dues not cut
down or alter any street curb and which is for residence or dwelling
house use may be established, built, constructed and maintained upon
permit issued by the Village Engineer without the President and Board
of Trustees order; provided, that all other requirements of this article
dealing with driveways shall be fully complied with.

All board orders for driveways shall be in the form of resolutions,
duly adopted by the President and Board of Trustees in open meetings,
assembled, and shall contain the name of the person making such application
for driveway, the location and dimensions of the proposed driveway,
the use to which it is to be devoted and whether in the building thereof
it will be necessary to cut down or alter the street curb or elevate
or depress the existing grade of sidewalks or parkways.
No permit for a driveway shall be issued upon order of the President
and Board of Trustees until written application therefor has been
made and the bond herein provided for has been filed.

Application for a permit for a driveway shall be made to the
Village Engineer, and shall contain the name and address of the person
making application and the proposed location and dimensions of such
driveway. Plans and specifications of such driveway shall be filed
with the Village Engineer and shall be accompanied by a bond executed
by the grantee, with sureties to be approved by the President and
Board of Trustees, running to the Village in the penal sum of $10,000,
conditioned upon the faithful observance of each condition and provision
of such permit, and conditioned further, to indemnify, keep and save
harmless the Village against all liabilities, judgments, costs, damages
and expenses which may in any-wise come against the Village in consequence
of the granting of such permit, or which may accrue against, be charged
to, or recovered from such Village, or by, reason, or on account of
any act or thing done by the grantee by virtue of the authority given
in such permit, or by reason or on account of any defect in the construction
or design of the driveway or fly reason or on account of the failure
to maintain the driveway in good condition and repair and free and
clear of snow, ice or obstruction of any kind. Such bond shall be
filed with the Village, clerk, and shall be kept in force throughout
the life of the permit, and if at any time during the life of the
permit such bond shall not be in full force, then the authority and
privileges herein granted shall thereupon cease.

Before any permit referred to in this article shall issue there
shall be paid to the Village Collector a permit fee of $30; provided,
however, that where the proposed driveway is a private driveway to
residential property and where such driveway is not over 16 feet in
width and will not depress or elevate the established grade of the
sidewalk then the permit fee shall be $5.
For all driveways now or hereafter maintained at any place other
than that used exclusively for charitable, educational or residential
purposes there shall be paid, for each license year following the
year in which the permit fee required above is paid, an annual permit
fee for maintenance, as follows:

Permits required by this article shall contain conditions as
follows: Such permit may be revoked by order of the President and
Board of Trustees in the form of a resolution, duly adopted by the
President and Board of Trustees in open meeting assembled, at any
time without the consent of the grantee, in which case the authority
and privileges granted shall thereupon cease and determine; upon the
termination by revocation, expiration or otherwise of the authority,
rights and privileges granted by the permit, the driveway therein
authorized shall be removed and the sidewalk space where the same
shall have been located shall be restored to its proper condition
to the satisfaction of the Village Engineer, so that the portion of
the sidewalk space used for the driveway shall be safe for public
travel and in the same condition as the remaining portion of the sidewalk
space, at the sole expense of the grantee therein, without cost or
expense of any, kind whatsoever to the Village; provided, that in
the event of the failure, neglect or refusal on the part of the grantee
to remove such driveway where directed so to do, the Village may proceed
to remove same and charge the expense thereof to the grantee. Such
permits may be revoked by the Village Manager for failure or neglect
to comply with the provisions of this article.

No permit shall be issued for any work to be done in and about
the construction of driveways until plans and specifications therefor
have been submitted to and approved by the Village Engineer. A copy
of such plans and specifications shall at all times be kept on file
in the space allocated to him in the Village Clerk's office for that
purpose. No alteration or change from such plans or specifications
shall be made without the written consent thereto of the Village Engineer.

Where driveways are to be built across the sidewalk spaces,
unless otherwise expressly authorized, they shall conform to the sidewalk
grade. Such driveways shall also provide for a conduit under such
sidewalk. Such driveways shall be eight inches in depth consisting
of a layer of concrete seven inches in depth and a top or finishing
layer one inch in depth or to be eight inches in depth on a one-course
job, consisting of concrete as specified for sidewalks except that
the broken stones, washed gravel or crushed, air-cooled, blast-furnace
slag shall be not more than two inches in any dimension. This work
shall be done in the manner and materials shall be of the quality
and proportions specified for Portland cement concrete walks except
that a cinder foundation shall not be required, provided, however,
that in the case of driveways across viaduct sidewalks, variations
of construction and materials to conform to existing condition may
be made when approved by the Village Engineer. No such work shall
be started until notice has been filed with the Village Manager.
No driveway shall be so constructed as to prevent free and unobstructed
passage on, over or across the same, or in such a manner as to interfere
with the proper drainage and safe grading of the streets. No driveway
shall be constructed across intersecting sidewalks. Gradual approaches
to the regular sidewalk grade shall be made from the grade of the
driveway. The slope of any driveway and the approaches thereto shall
not exceed one inch vertical to one-foot horizontal nor be less than
one-fourth inch vertical to one-foot horizontal in any direction,
except that the slope from street curb line shall not exceed one inch
vertical to one-foot horizontal. The concrete mix shall contain not
less than six hags of Portland cement per cubic yard of concrete (or
60 square feet of five-inch walk.)

The superintendent of streets and alleys shall remove all parking
meters and all traffic signs located in that portion of any public
sidewalk of public parkway over which a driveway is to be constructed
or which are so located with reference to the proposed driveway as
to unreasonably interfere with the use of the driveway or the operation
of the parking meters. In such case no driveway permit shall be issued
until the applicant shall first pay to the Village Collector a fee
of $20 for each parking meter and a fee of $20 for each such traffic
sign to be so removed.
