As used in this article, the following terms shall have the
meanings indicated:
AUCTIONEER
Any person who exposes for sale by auction any goods or articles,
except provisions, charcoal, wood, the products of a farm and secondhand
household furniture, and who is not a resident of the Town.
ITINERANT VENDOR
Any person who engages in a temporary or transient business
in the Town of Winchester selling goods, wares and merchandise and
who, for the purpose of carrying on business, hires, leases or occupies
a building or structure, or space, for the exhibition and sale of
such goods, wares and merchandise.
No person shall engage in the business of "itinerant vendor"
or "auctioneer" unless such person has a license to do so from the
Chief of Police and has received any other required local or state
permits or licenses.
The fee for such license shall be $250.
In the case of a license for an itinerant vendor, upon payment
of such fee, the Town Clerk shall endorse thereon the words "local
license fees paid" and shall affix thereto his official signature
and the date of such endorsement.
An auctioneer's license shall remain in force for one year from
its date of issue. An itinerant vendor's license shall remain in force
as long as the licensee continuously keeps and exposes for sale a
stock of goods, wares and merchandise but not later than the first
day of October following the issuance of the license.
Any person who shall violate any other provision of this article
shall be fined $150 and the Chief of Police shall revoke the license
of any person convicted of violation of any of the provisions of this
article; and each sale made in violation of the provisions and regulations
herein contained shall constitute a separate offense.
