From and after the passage of this article, it shall be unlawful for property owners in said Borough to extend beyond the line of his or her lot any flat cellar doors, areaways and steps into dwelling houses, stores or other buildings a greater distance than three feet six inches, except as permitted in § 440-16, including railing, on any of the streets of said Borough.
No cellar door or cellar doors shall be constructed so as to
rise above the level of the pavement; no areaway shall be so constructed
unless the same is protected by an iron railing and a grate across
the entrance to the same.
If any person shall place or cause to be placed any cellar door,
cellar doors, areaway or steps extending beyond the line of his or
her lot more than three feet six inches and shall fail to remove the
same within three days after notice given by the Mayor, he, she or
they so offending shall forfeit and pay as a penalty for so doing
the sum of $50, to be collected by law as debts of like amount are
now by law collectible.
Further, on failure of said property owner to comply with said
notice and remove the said obstruction and close up said opening,
the Mayor shall proceed according to law to remove the same and collect
the cost of said removal from said property owner in addition to said
penalty.

A.
Council may grant permits for the making of an opening in the sidewalks,
at a greater distance than three feet and six inches beyond the property
lines of any property in the Borough of Clearfield, for the purpose
of constructing areaways into basements or cellars, provided that
all applications for such permits be made in writing, accompanied
by complete plans and specifications of the proposed improvements
or constructions, and that the work be done under the supervision
of the Borough Engineer and subject to his approval.
B.
All openings and excavations made under the provisions of this article
shall be subject to the ordinance regulating the making of excavations
in streets, alleys and highways of the Borough, which ordinance was
approved the seventh day of March 1928,[1] and when the coverings to said areaways are opened or
removed, proper barriers shall be placed around the openings sufficient
to protect the users of the sidewalks and streets from danger.
