From and after the passage of this article, all persons engaged
in the mining and selling of bituminous coal within the limits of
the Borough of Clearfield, in the absence of a different contract,
shall sell such coal by weight, and 2,000 shall be one ton.
It shall be the duty of all persons selling coal or delivering
bituminous coal to citizens of the Borough, in the absence of a different
contract, to first have the same weighed by some competent weighmaster
and present the certificate of such weighmaster to the vendee, setting
forth the amount of coal in each load delivered.
Any person violating this provision shall forfeit and pay to
the use of the Borough the price or sum of $3 for each and every load
of coal so offered for sale, to be collected as debts of like amount
are now by law recoverable.
Any person keeping scales for weighing coal sold within the
Borough shall permit the Mayor or Borough Council or anyone authorized
to enter upon his premises to inspect said scales as often as may
be deemed necessary.
When said scales shall be found deficient, the Mayor shall at
once notify the person or persons owning the same, who shall at once
have such scales made to weigh accurately, under a penalty of $5 for
every failure to repair the same after 24 hours' notice, said penalty
to be collected by the Borough as debts of like amount are now by
law recoverable.
