Any sewer account becoming delinquent for 30 days or more shall carry interest at a rate as prescribed by N.J.S.A. 40A:26A-17, and any sewer account becoming delinquent for six months or more shall be subject to disconnection.
Not less than 45 days prior to disconnection, the record owner whose name or names appears on the tax duplicate in the office of the City Assessor shall be notified of the proposed disconnection by certified mail, return receipt requested, and regular mail. The City Tax Collector shall notify the City Clerk who will then prepare and send out the notice. The City Clerk shall provide a list of proposed disconnections to the Mayor and Council at the next subsequent City meeting.
If the outstanding arrearage is not satisfied within 45 days from the date of the notice, and if no hardship waiver has been granted, then the North Wildwood Sewer Department may disconnect the delinquent sewer service.
A. 
Any person or entity suffering under a hardship may apply, prior to the date set for disconnection, for a hardship exemption from disconnection by filing an application with the North Wildwood City Clerk. Said application shall be referred to an independent review board to be designated by the Mayor and Council. The review board shall analyze the application in accordance with rules and regulations to be promulgated by the Mayor and Council of the City of North Wildwood, adopted by resolution.
B. 
Any exemption granted shall be based upon an installment payment agreement, which shall call for monthly payments over a period of not more than 18 months. The agreement shall provide that upon failure of the sewer user to make any payment by the date set forth in the agreement, or in the event there is a failure to pay the current sewer bill or bills, the City shall have the option to terminate the agreement and disconnect the property from the sewer system upon at least 10 days' written notice.
Any sewer service which is disconnected pursuant to this article may be reconnected upon application of the record owner upon payment of the following:
A. 
All outstanding real estate taxes and sewer delinquencies.
B. 
A reconnection fee as follows:
(1) 
First offense: $300.
(2) 
Second and all subsequent offenses: $800.
The North Wildwood Sewer Department shall notify the Cape May County Health Department, the North Wildwood Board of Health and the North Wildwood Clerk of each and every disconnection, and subsequent reconnection, which it effectuates, and the City Clerk shall notify the Tax Collector.
