As used in this chapter, the following terms shall have the meanings
indicated:
KEEPER or PERSON
Any person, firm or corporation owning or actually keeping, having,
using or maintaining any of the animals herein referred to.
LARGE ANIMALS
All individual species of the bovine (Bovidae), equine (Equidae),
swine (Suidae), sheep (Ovis) and goat (Capra) families.
PERSON
Includes any individual, firm or corporation.
RATPROOF
A state of being constructed so as to effectively prevent entry of
rats.
SANITARY
Any condition of good order and cleanliness, which precludes the
probability of disease transmission.
SMALL ANIMALS
Rabbits, hares, guinea pigs, chinchillas, chickens, turkeys, geese,
ducks, hamsters, pigeons (except homing pigeons), rats, mice, dogs, cats and
other animals ordinarily considered to be household pets.

A. There is hereby created the position of Animal Control
Officer, who shall be appointed by and serve at the will of the Borough Council.
B. The Animal Control Officer shall have the power to:
(1) Enforce the provisions of this chapter and amendments
thereto.
(2) Make such rules and regulations, with the consent of
the Borough Council, as he shall deem necessary to carry out the purposes
and provisions of this chapter and amendments thereto.
(3) Determine whether any person is violating any provision
of this chapter and amendments thereto.
(4) Determine whether any person is violating any rule or
regulation adopted pursuant to this chapter.
C. In making a determination, the Animal Control Officer
shall consider the following standards:
(1) All animals and animal quarters shall be kept in a clean
and sanitary condition, maintained with adequate ventilation.
(2) Animal owners, custodians or keepers shall use every
reasonable precaution to assure that the animals are not teased, abused, mistreated,
annoyed, tormented or in any manner made to suffer by any means.
(3) Animals which are enemies by nature or which are temperamentally
unsuited shall not be quartered together or so near each other as to cause
the animals fear or to be abused, tormented or annoyed.
(4) Animal owners, custodians or keepers shall maintain the
premises used to house or keep animals so as to eliminate offensive odors
or excessive noise.
(5) Animal owners, custodians or keepers shall not permit
any condition causing disturbance of the peace and quiet of his neighbors.
(6) Animals must be maintained in quarters so constructed
as to prevent their escape. The animal owner, custodian or keeper assumes
full responsibility for recapturing any animal that escapes from his premises
and shall make adequate provisions and safeguards to protect the public from
the animals.
(7) Every person shall conform to all present and future
laws of the Commonwealth of Pennsylvania and the United States of America,
the ordinances of the Borough of Monaca and the rules and regulations promulgated
pursuant thereto in any way connected with animals, specifically including
anticruelty laws.
Except for farms considered operational at the time of passage of this
chapter, large animals and any other animals not ordinarily considered as
house pets are prohibited within the corporate limits of the Borough of Monaca.
All other animals may be kept under the conditions hereinafter set forth.

No person shall keep within the Borough of Monaca a combined total of
more than six small animals; provided, however, that there may be also maintained
in any dwelling unit six puppies or kittens up the the age of six months.
There shall be no commercial intent in the keeping of any fowl within the
Borough.
Persons who keep small animals shall provide facilities for the keeping
of such small animals in quarters as set out herein, which will confine said
small animals within limits not closer than 25 feet to the exterior limits
of any dwelling resided in by anyone other than the animal keeper.
A. Every keeper of any small animal shall confine the same
in a manner to prevent its running at large, and the area of confinement shall
be maintained in a clean and sanitary manner at all times.
B. The area of confinement for an animal shall be of sufficient
size to be conducive to good sanitation practices and provide adequate and
sanitary drainage.
C. Each keeper of small animals shall cause the litter and
droppings therefrom to be collected daily in a container or receptacle of
such a type that, when closed, it is ratproof and flytight and, after each
such collection, shall cause such container or receptacle to be kept closed.
At least twice a week, each such keeper shall cause all litter and droppings
so collected to be disposed of in a way as not to permit the presence of fly
larvae.
D. Every keeper of any small animals shall cause all feed
provided therefor to be stored and kept in a ratproof, flytight building,
box, container or receptacle.
E. The premises shall be subject to inspection by any authorized
representative of the Borough at any reasonable hour of the day.
Game cocks or fighting cocks shall not be kept in the Borough.
Any violation of this chapter that would constitute a violation of any
state statute shall be prosecuted under the state statute.

Any person or persons, firm or corporation violating the provisions of this chapter shall be punishable as provided in Chapter
1, Article
II, Code Enforcement.
