The following article pertaining to the installation and operation
of sewage disposal systems is based upon the provisions of RSA 149.
No permit for construction of a building nor emplacement of
a mobile home generating effluent shall be issued until a septic system
approval has been issued, in writing, by the New Hampshire Water Supply
and Pollution Control Commission, hereinafter referred to as the "Commission."
No contractor shall perform any work relative to septic systems
(routine maintenance such as pumping excepted) until a construction
approval certificate is issued by the Commission and said certificate
is posted in a conspicuous place at the construction site.
Any septic system approved for construction must be inspected
at certain stages as specified by the Commission, its agent or the
local inspecting authority as designated by the Selectmen and approved
by the Commission.
Upon completion of a new system or modification of a failed
system, the system shall not be placed in use until an approval for
operation is received from the Commission or its designated agent.
The above provisions apply in all respects to any failed system
requiring relocation, extension, modification or new construction.
Failure to comply with this article in any or all of its parts
by any owner, lessee or tenant and/or any contractor performing service
to a septic system shall result in either or both being subject to
a fine of $1,000. In the event of a failed system and when notified
by an official of the Town to cease operation of said failed system,
then effective as of 12:00 noon of the day following such notification,
and for each day or part thereof, a fine of $25 per day of operation
shall be assessed against the owner, lessee or tenant of the property
on which the failed system exists.
Any Town officer (the Selectmen, any police officer, the Fire
Chief, Health Officer, Building Inspector, and agent for the Commission)
may enter upon any land or establishment for the purpose of investigating
a complaint relative to a failed septic system or for the purpose
of obtaining information necessary to the purpose hereof. No owner,
lessee or tenant of such land or establishment shall refuse admittance
to any such officer, nor shall they in any manner impede the lawful
inquiry by an officer of the Town.
