Pursuant to the provisions of RSA 147:1, the following regulations relating to the health and safety of the people of the Town of Raymond, New Hampshire, are hereby promulgated by the Health Officer of the Town of Raymond.
No private sewage disposal system, including, but not limited to, privies, cesspools, septic tanks, dry wells and/or leach fields, shall hereafter be constructed or installed less than 37 1/2 feet from property boundary lines, except road lines. Setback requirements of systems from road lines is to be 37 1/2 feet less 1/2 the width of the road, but not less than 10 feet.
A. 
No well shall hereinafter be constructed within 37 1/2 feet of any property line.
B. 
No well shall be located less than 75 feet from any private sewage disposal system, including but not limited to, privies, cesspools, septic tanks, dry wells and/or leach fields.
No private water supply line shall be crossed by any sewage disposal system line, unless encased as specified by the State of New Hampshire Water Supply and Pollution Control Commission.
For the purpose of this chapter, the following terms shall have the meanings indicated:
PRIVATE SEWAGE DISPOSAL SYSTEM
Any sewage disposal system or part thereof not owned or operated by the Town of Raymond.
PRIVATE WATER SUPPLY LINE
Any water supply line lying within any property line, excepting municipally owned main supply lines.
No private sewage disposal system shall serve or be allowed to continue serving more than one dwelling, except that in a mobile home park, one system may service no more than two mobile homes, except where a single state-approved system serving the entire mobile home park is installed.
Plans for all proposed private sewage disposal systems shall be drawn to scale and in accordance with the current regulations as prescribed by the State of New Hampshire Water Supply and Pollution Control Commission and shall include the location of all existing wells situated within 100 feet of any part of said proposed systems. Plans shall also include the location of any well to be constructed on the lot.
Test holes and percolation tests shall be performed prior to the design of any septic system within the Town of Raymond. These test holes and percolation tests will be observed by the Town of Raymond Health Officer. The fee for such will be $50 per test. If more than one test is necessary for any one lot, the fee shall be $25 per hour. This regulation will also apply to those tests required by the state for Water Supply and Pollution Control Commission subdivision approval.
Plans for all private sewage disposal systems and subdivision plans shall be submitted to the Health Officer of the Town of Raymond prior to submission to the State of New Hampshire Water Supply and Pollution Control Commission for signature of the Health Officer.
No construction, alteration, expansion or replacement of any private sewage disposal system or any part thereof or of any well shall commence until the plans submitted as hereinabove required have been approved, in writing, by the Health Officer of the Town of Raymond and by the State of New Hampshire Water Supply and Pollution Control Commission.
A. 
All private septic systems for residential use shall be designed for a minimum of three bedrooms and have a minimum of a one-thousand-gallon concrete septic tank.
B. 
All septic designs for multifamily dwellings must be designed for minimum usage as two-bedroom units.
C. 
All septic designs for multifamily dwellings must include designed flow usage for washing machines.
Any regulations above may be waived by the Health Officer with the approval of the Board of Selectmen, provided the granting of such waiver does not adversely affect any adjoining property based on these regulations and that all State of New Hampshire Water Supply and Pollution Control Commission regulations are met.
Septic system inspections include:
A. 
Witness test pits.
B. 
Review septic design prior to submission to state; state continues to approve design plans.
C. 
Inspect septic bed bottoms (Town of Raymond); state continues to inspect installed systems and certificate of operation is relinquished to the Town.
D. 
Make final inspection to ensure complete compliance.
E. 
Issuance of certificate of operation by the Town of Raymond.
A. 
Well construction standards.
(1) 
Any proposed new or replacement well to be constructed in the Town of Raymond shall have its location shown on a proper plot plan and be approved by the Health Officer prior to its installation.
(2) 
Any new or replacement well constructed in the Town of Raymond shall have a water quality test conducted at the installer's expense. The results of such test shall indicate the water to be of drinking water quality before it may be used as a drinking water supply for any dwelling.
B. 
The Town of Raymond shall not be liable for any wells that develop water quality problems due to unforeseen circumstances or undisclosed information.
Any person who violates any of the provisions and regulations herein shall be punished as provided by RSA 147:1, III, or any amendments of successors thereto.
Any provision of these regulations which may be found unlawful or unconstitutional by a court of law or other competent body shall not affect the remaining portions thereof.
