All definitions as described in § 943.61(1)(a) through (c), Wis. Stats., and amendments thereto, are adopted herein by reference.
Whoever intentionally takes, carries away, transfers, conceals or retains possession of any library materials as defined in § 943.61(1)(c), Wis. Stats., and amendments thereto, without the consent of a library official, agent or employee, with intent to deprive the library of the possession of the materials may be penalized as provided in § 278-4 below.
The concealment of library materials beyond the last station for borrowing library material is evidence of intent to deprive the library of possession of the materials. The discovery of library materials which have not been borrowed in accordance with the library's procedures, and taken without consent of a library official, agent or employee, and which is concealed upon the person, or among the belongings of the person, or concealed by a person upon the person, or among the belongings of another, is evidence of intentional concealment on the part of the person so concealing the materials.
A. 
The forfeitures for a violation of this article are as follows:
(1) 
First offense: $30, plus applicable court costs and all costs of prosecution of this offense, plus return of library materials or cost of replacement of library materials.
(2) 
Second offense within one year: $40, plus applicable court costs and all costs of prosecution of this offense, plus return of library materials or cost of replacement of library materials.
(3) 
Third offense within one year: $60, plus applicable court costs and all costs of prosecution of this offense, plus return of library materials or cost of replacement of library materials.
B. 
Any amendments to the forfeiture schedule for violation of this article may be established by a resolution adopted by a majority vote of the Common Council of the City of Hayward.
