A. 
The purpose of this district is to promote the public health, safety, and general welfare by:
(1) 
Prohibiting floodplain uses such as fill, dumping, storage of materials, structures, buildings and any other works which, acting alone or in combination with other existing or future uses, will increase potential flood heights and velocities; and by
(2) 
Requiring the storage or processing of materials that are buoyant, flammable, or potentially dangerous to human, animal, or plant life and the construction, reconstruction, or alteration to structures and buildings on or that are moved on the floodplain to be elevated above the flood potential in such a way to prevent future loss of life and property damage, public responsibilities for rescue, and relief, and the installation of public streets, sewer, water and other public utilities or services below the flood potential.
B. 
NOTE: This overlay district will be added to the City of Hayward Official Zoning Map as soon as the State of Wisconsin Department of Natural Resources and the U.S. Army Corps of Engineers have established flood elevations for the Namekagon River through Hayward. In the interim, the City will consider the record high water mark for Lake Hayward and the Namekagon River as the boundaries of the floodplain overlay district.
Any open space use as permitted in the underlying districts, subject to the standards set forth in all Wisconsin Statutes and Administrative Codes governing the use of areas subject to flooding.
