All residential and commercial dumpsters must have a six-foot-high opaque enclosure. Gates and lids to dumpsters must be kept closed at all times when not in use.
Each dumpster must be of sufficient size and capacity to eliminate overflowing. The property owner or authorized agent of the premises utilizing the service must take appropriate action immediately to empty contents when full.
A. 
It shall be the responsibility of the property owner or agent being serviced to maintain the dumpster area free of odors, scattered debris, overflowing and all other nuisances.
B. 
The dumpster contractor shall have the dumpster deodorized or, if necessary, washed or sanitized as directed by order of the enforcement agency.
The Building Commissioner and Board of Health shall be charged with the interpretation and enforcement of this article and may also be enforced by the Hull Police Department. Enforcement of this article may be by criminal complaint, indictment, non-criminal disposition or appropriate civil enforcement action. Selection of one method shall not preclude the selection of any other method or remedy.
Any person or entity who is found in violation of this article shall be liable for a fine of $25 a day. Each day is a separate violation. This section shall not be effective until 60 days after the approval of this article by the Attorney General.
Any clause, section or part of this article determined to be invalid by any judiciary for any reason shall be severable from any other clause, section or part, without effecting the validity of that which remains.
