The Office of Public Defender is hereby established.
The Judge of the Municipal Court of the City of Gloucester City is authorized to make decisions as to which defendants are indigent, and after a determination is made, the Public Defender shall represent the defendant.

The Court Clerk shall charge a fee of $200 per application for a Public Defender. The Judge of the Municipal Court of the City of Gloucester City is authorized, based upon his or her determination, to waive the fee, or part of the fee, only upon a clear and convincing showing that the application fee represents an unreasonable burden on the person seeking representation. The Judge of the Municipal Court of the City of Gloucester City is specifically authorized to require that the application fee be paid at once or in installments over a period of four months or less from the date of the application by the person seeking representation.
The application fee shall be used to help defray the cost of hiring a Public Defender and in the administrative costs of the Municipal Court of the City of Gloucester City.
