A. 
Definition. For the purpose of this section, a roll-off dumpster or roll-off container shall be defined as a container used on a temporary basis for the disposal of waste or refuse (hereinafter referred to as debris) generated by the construction, reconstruction and/or rehabilitation of a structure within the City of Gloucester City. Dumpsters used for other purposes, including but not limited to food waste, general commercial waste, building debris from other sites and so on, are governed by the Gloucester City Development Ordinance.
B. 
No person shall park or leave unattended any waste or refuse container, commonly known as a "roll-off dumpster" or "roll-off container," on or along any public highway or right-of-way or on public property or private property, without first obtaining permits from the Building and Housing Department in the amount of $25 for the first month and $50 for each additional month thereafter. Consent shall be valid and remain in effect for a period of not more than 30 days but may be renewed by the Construction Official after appropriate application and approval.

C. 
To warn the operators of vehicles of the presence of a traffic hazard requiring the exercise of unusual care, any roll-off dumpster or roll-off container parked on or along any public highway or right-of-way or public property shall be equipped with and display markers consisting of all-yellow reflective diamond-shaped panels having a minimum size of 18 inches by 18 inches. These panels shall be mounted to the edge of the dumpster or container at both ends nearest the path of oncoming traffic. These markers shall have a minimum mounting height of three feet from the bottom of the panels to the surface of the roadway.
D. 
The debris to be placed in a roll-off dumpster or container shall be only the waste or refuse generated by construction, reconstruction and/or rehabilitation of structure(s) at the property site for which the application is submitted and approved.
E. 
Roll-off dumpsters or containers may be placed on private property only for the purpose of disposal of building construction, reconstruction and/or rehabilitation debris from structures located on said private property. A permit is required for private property placement of a roll-off dumpster.

F. 
No roll-off dumpster or container shall be overfilled with debris whereby the contents exceed the top of the container. Any full container shall be removed within two business days of becoming full, unless for the purposes of the health, safety and welfare of the community an earlier removal is warranted as determined by the Construction Official.
G. 
A person who is convicted of a violation of this section shall pay a fine of not less than $100 and not more than $1,250 for each violation. Each violation of this section and each day the same is violated shall be deemed and taken to be a separate and distinct offense. In default of the payments of a fine, imprisonment in the county jail for a period of not more than 90 days may be imposed.

A. 
No person shall park or leave unattended any moving container, moving pod, storage pod or other similar containers commonly used to facilitate moving personal property, on or along any public highway or right-of-way or on public property, without first obtaining permits from the Housing and Building Department. The permit shall be in the amount of $25 and will remain in effect for a period of not more than 15 calendar days; however, may be renewed by the Construction Official after appropriate application and approval. Applicant will notify the Police Department upon approval of application as to the location of the container.
B. 
Failure to submit the required application and fee or failure to remove the approved container by the expiration date may result in a fine of not less than $100 and not more than $2,000 and/or a period of community service not exceeding 90 days.
