Pursuant to the provisions contained in 65 Illinois Compiled
Statutes 5/11-10-2, there shall be elected biannually by ballot, from
the active firemen of the Village, at which election all active firemen
of the Village shall be entitled to vote, three firemen to constitute
a board to be known as the fire department board of the Village. Such
board shall designate one of their number as President, another as
secretary, and a third as treasurer; provided, however, that in lieu
of appointing a treasurer, the Finance Director may be designated
as ex officio treasurer of the board. In the event that a person other
than the Finance Director is appointed treasurer, he shall give a
sufficient bond to the Village, which bond shall be approved by the
President, conditioned upon the faithful performance by the treasurer
of the duties of his office, as required by law.

In the event of the failure, resignation or inability of any
member of the fire department board elected under the provisions of
the preceding section to serve, the successor to each member shall
be elected at an election which shall be called by the board, and
shall be conducted in the same manner as the biannual election. Each
member shall hold his office until his successor is duly appointed
and qualified.

The fire department board shall make all needful rules and regulations
with respect to the department and the management of the money to
be paid to the treasurer. The Finance Director shall pay to the treasurer
of the fire department, or shall set aside, all sums received by the
Village from foreign fire insurance companies as provided by law and
all such monies so received from foreign fire insurance companies
shall be paid out upon the order of the fire department board for
the maintenance, use and benefit of the fire department.

It shall be unlawful for any corporation, company or association,
not incorporated under the laws of the state, to engage in the Village
in effecting fire insurance or to transact any business of fire insurance
in the Village while in default by not fully complying with the requirements
of this article, and such disability shall continue until such requirements
shall have been fully complied with; but this provision shall not
relieve any company, corporation or association from the payment of
any risk that may be undertaken in violation of the provisions of
this article.

Any corporation, company or association not incorporated under
the laws of the state which is engaged in the Village in effecting
fire insurance shall annually pay to the Finance Director, for the
maintenance, use and benefit of the fire department of the Village,
a sum of money equal in amount to 2% per annum of the gross receipts
received for premiums by any and all agents of any such corporation,
company or association during the year ending on July 1 for any insurance
effected or agreed to be effected in the Village by or with any such
corporation, company or association during such year.

Every person acting as agent for or on behalf of any corporation,
company or association subject to the tax levied by this article shall,
on or before July 15 of each and every year, render to the Village
Clerk a full, true and just account, verified by his oath, of all
premiums which, during the year ending on July 1 preceding such report,
shall have been received by him or any other person for him in behalf
of any such corporation, company or association. Such agent shall
also, at the time of rendering the aforesaid report, pay to the Finance
Director the sum of money for which such company, corporation or association
represented by him is chargeable by virtue of the provisions of this
article.

The sum of money for which such company, corporation or association
is chargeable under this article may be recovered of it, or its agent
or agents, by an action in the name of and for the use of the Village,
as for money had and received.
Nothing in this section shall be held to exempt any person,
corporation, company or association from indictment and conviction
under the provisions of 65 Illinois Compiled Statutes 5/11-10-1 et
seq.

No insurance broker in the Village shall place any insurance
with any company, association or corporation not incorporated under
the laws of the State, which shall be in default for not reporting
or making payment as hereinbefore provided, until it shall have complied
with all the requirements of this article.
