No person shall be allowed to excavate or remove any earth or
other material under any sidewalk to a greater distance than 10 feet
from the line between any lot and the street upon which the lot abuts;
and no person shall in any event form any area under a sidewalk without
first constructing a perpendicular wall of stone or brick at least
six feet high, one-foot thick and 10 feet from and at parallel to
the from line of his lot abutting on the street. Such wall shall be
laid in mortar or cement, and shall be faced to a true line on the
outer side thereof and brought plumb and flush to the grade of the
underside of such sidewalk, and laid and constructed under the supervision
and direction of the Village Manager.

No person, unless authorized by the Village Clerk or by ordinance,
shall make any excavation in any street, avenue, sidewalk or public
ground within the Village without first obtaining a permit therefor
according to the provisions of this article where the provisions thereof
apply, and in all cases without obtaining a permit from the Village
Manager.

Before a permit required by the preceding section shall be granted
to any person to open any street, sidewalk, alley, avenue or public
place, for any purpose, an estimate of the cost of inspection as hereinafter
provided, and of restoring the pavement and the surface of the street,
sidewalk, alley, avenue, or public place to a condition equally as
good as before it shall have been so opened, to the satisfaction of
the Village Manager, with a fair additional sum as margin for contingent
damages, to be determined by the Village Manager, shall be made by
the Village Manager, and the permit shall be issued and transmitted
to the collector, who, before delivering the same, shall collect the
amount of such estimate and the fee for the such permit.
After completion of the work to the satisfaction of the Village
Manager the amount of any surplus remaining from the amount deposited
in such case shall thereupon be turned over to the proper claimant.
In addition to the deposit required by the preceding section
every person before being granted a permit to open any street, sidewalk,
alley, avenue or public place in the Village shall execute a bond
to the Village in the penal sum of $1,000 with sureties to be approved
by the President and Board of Trustees, conditional that such person
shall comply with all of the provisions of this article and with all
reasonable rules and regulations of the Village Manager in respect
to such excavations.

Whoever shall dig or make any ditch, drain, excavation or hole in, across or under any street, alley, sidewalk or public place within the Village, and shall not with all reasonable dispatch refill the same and replace such street, alley, sidewalk or place in as good condition its the same was found, or shall, during the existence or continuance of any such ditch, drain, excavation or hole, fail to have the same so watched, guarded and protected as to insure the safety of all persons who may pass by or near the same, shall be guilty of maintaining a nuisance, and shall be punished as provided in Section
13-3.

Any contractor, builder, owner or agent who shall, under the
ordinances of the Village be allowed to place any obstruction upon
or make any excavation in any street, alley, avenue or sidewalk, shall
be required to place and maintains, from sunset to sunrise of each
day, at each approach to such obstruction or excavation, a red light
or lantern which can be easily seen from each direction, and shall
also erect or place railings or barricades around such obstruction
or excavation where necessary to protect the public.
