The following words, when used in this article, shall have the meaning ascribed to them in this section, except in those instances where the context clearly indicates otherwise:
DOWNTOWN MONACA BUSINESS DISTRICT SIDEWALKS
Includes all sidewalks fronting on Pennsylvania Avenue from 4th Street to 17th Street, all sidewalks fronting on 9th Street from Atlantic Avenue to Pennsylvania Avenue, all sidewalks on 10th Street from Maple Alley to Pennsylvania Avenue, all sidewalks on 11th Street from Maple Alley and Virginia Avenue to Pennsylvania Avenue, all sidewalks on Wall Street from Pacific Avenue to Pennsylvania Avenue, all sidewalks on 12th Street from Pacific Avenue through Pine Alley, all sidewalks on 13th Street from Pine Alley to Pennsylvania Avenue, all sidewalks on 14th Street from Spruce Alley to Pennsylvania Avenue and all sidewalks on 16th Street from Pine Alley to Pennsylvania.

SIDEWALK
Includes any portion of a street or highway in the Borough of Monaca located outside the cartway and may include a paved footway, unpaved grassplot, curb and gutter or so much thereof as the Borough Council shall in any instance stipulate, but in every case it shall include at least the paved footway.
Every owner of property in the Borough of Monaca shall, on 30 days' notice from the Borough Council, construct or reconstruct a sidewalk, which shall conform to all applicable requirements of this article, in front of and/or alongside such property.
Every owner of property in the Borough of Monaca shall, on 30 days' notice from the Borough Council, repair the sidewalk, in the manner and to the extent stipulated in such notice, in front of and/or alongside such property.
In new developments, located in the Borough of Monaca, sidewalks shall be constructed, reconstructed and repaired in accordance with Chapter 210, Subdivision and Land Development. The notice requirements in §§ 205-3 and 205-4 of this article shall be adhered to by the property owner in case of reconstruction or repair of any such sidewalk.
A. 
All sidewalks shall be constructed, reconstructed and repaired of concrete only, in conformity with specifications adopted by the Borough Council from time to time. All sidewalks hereafter constructed shall be paved to a width of five feet, provided that, on any street in the Borough except Pennsylvania Avenue, Ninth Street and Indiana Avenue between Ninth Street and the east Borough line, where a sidewalk shall have been constructed of a width of eight feet or 10 feet, exclusive of grassplot, and the property owner shall desire to reconstruct such sidewalk or the Borough shall order the reconstruction thereof by reason of its condition, such walks shall be relaid in such manner that the paved portion shall be five feet wide, with curb and grassplot or grassplots located as directed by the Borough Engineer.
B. 
Specifications for Downtown Monaca Business District sidewalks. In addition to the foregoing requirements, the Downtown Monaca Business District sidewalks shall be constructed, reconstructed and repaired in accordance with the specifications set forth in Attachment A, attached hereto, made part hereof and incorporated herein.[1] Every individual, business, corporation, public agency or public utility shall apply for and be granted a permit, on a form prescribed by the Borough, prior to undertaking any construction, reconstruction or repair of any Downtown Monaca Business District sidewalk. The permit application shall elicit information, including but not limited to the applicant's name and address, the area to be constructed, reconstructed or repaired and that the applicant is aware of and agrees to be bound by the provisions of any and all ordinances relating to sidewalks generally and sidewalks in the Downtown Monaca Business District.

All sidewalks shall be laid in conformity with lines and grades given by the Borough Engineer and shall have a rise of 1/4 inch to the foot from the outer edge of the sidewalk to the inner edge thereof. The grassplot shall have a fall of 1/2 inch to the foot. Curbs and gutters shall conform to specifications adopted by the Borough Council from time to time.
It shall be the duty of the Borough Engineer to determine, in case of any individual property, whether a sidewalk shall be reconstructed or whether it shall be repaired and, in either case, the specific part or parts thereto to be reconstructed or repaired. The Engineer may, at any time during the course of constructing, reconstructing or repairing any sidewalk, visit the site of such work to ascertain whether such work is being done according to requirements; and he or one of his assistants shall visit such site for such purpose, at any reasonable time, when so requested by the property owner. Within two days after the completion of the work of construction, reconstruction or repair of any sidewalk, it shall be the duty of the owner of the property where such work was done to notify the Borough Engineer of that fact, so that he may inspect such sidewalk to determine whether the work was done in conformity with the requirements of this article.
Any property owner, upon his initiative and without notice from any Borough authority, may construct, reconstruct or repair a sidewalk in front of or alongside his property, provided that such owner shall first make application to the Borough Engineer for the line and grade and shall conform to the requirements of this article as to line, grade and specifications, and that he shall notify the Borough Engineer, as required by § 205-8 of this article, within two days after completion of the work.
In any case where a property owner shall fail, neglect or refuse to construct, reconstruct or repair a sidewalk as required by this article, within the time limit stated in the notice to do such work, or when such work, whether done upon notice by the Borough or upon the initiative of the property owner, shall not be in conformity with the requirements of this article and/or the notice to do such work, the Borough shall have the authority to cause such work to be done or to be rectified in case of work improperly done and shall collect the cost of such work or of such rectification, as the case may be, with 10% additional, from such defaulting property owner in the manner authorized by law.
