The Town of Raymond, New Hampshire, shall no longer be responsible to replace, repair or reimburse for damage to structures or improvements located within the right-of-way of any Town-maintained road, with the only exception of properly installed and maintained mailboxes, located in the right-of-way because of land configurations that make it impossible to install a mailbox anywhere else, which are physically struck by Town maintenance equipment.
Such structures or improvements shall include but not be limited to the following: improperly installed and maintained mailboxes, fences, stonewalls, lawns, driveways or other objects located within the right-of-way.
It shall be the responsibility of the property owner to replace, repair or relocate any structures or improvements within a Town right-of-way which has been damaged or destroyed as a result of Town road maintenance activities, either winter or summer related.
Individuals, corporations or firms erecting, placing or otherwise allowing the erection of a structure in the Town's right-of-way shall be held liable for any damage caused by the structure to Town-owned equipment should said damage have been sustained while the equipment was in the course of its normal activities.
Person or persons damaging Town property such as hydrants, trees, fences, etc., shall be held liable for any damage to said Town property if damaged by said person or persons.
