The following definitions shall be applicable for the purpose of this chapter:
ALARM CONDITIONS
Alarms activated by an unlawful violation of a user's property, other violations that the systems were designed to protect against, acts of God, other violent conditions, outside agencies, and hazards of external forces not under the control of the owner, lessee or his employee or agent.
ALARM EQUIPMENT SUPPLIER
Any person that sells, leases, installs or otherwise deals in automatic protection devices or signaling devices which transmit alarms upon a stimulus from a detection apparatus or a manually operated system.
ALARM USER
Any person on whose premises an alarm system is maintained within the Village, including those systems which employ an audible signal emitting sounds, or a flashing light or beacon designed to alert or signal persons outside of the premises.
CENTRAL STATION
A facility whose prime purpose is to monitor incoming alarm signals 24 hours a day and relay the signal information to the appropriate authorities.
DIRECT LINE
A telephone line leading directly into the communications center of the Police or Fire Department that is for use only to report signals on a station-to-station basis.
FALSE ALARM
The activation of an alarm system caused by improper operation, negligence of the owner or lessee or his employee or agent, or equipment malfunction.
INCORRECT ALARM
An alarm condition resulting from the proper operation of the system responding to a condition other than a true alarm occurrence.
LOCAL ALARM
A signaling system which, when activated, causes an audible and/or visual signaling device to be activated in or on the premises within which the system is installed.
MALFUNCTION
An alarm condition resulting from the proper operation of the system responding to a condition other than a true alarm occurrence.
PERSON
Any individual, partnership, corporation, association or society, but such term does not include the Village.
POLICE CHIEF or FIRE CHIEF
The Chief of the Police Department or the Fire Department of the Village, or his authorized representative.
PUBLIC TRUNKLINE
A telephone line leading into the communication center of the Police or Fire Department that is for the purpose of handling emergency and administrative calls on a person-to-person basis.
SIGNAL BOARD
A system located in the Police or Fire Department to receive visual and audible signals over direct lines to note a fire, burglary or other emergency at specific locations within the Village.
SIGNALING DEVICE
An electrically operated instrument which automatically sends visual and/or audible signals to be registered by indicators at a monitor panel at the receiving terminal or central station.

A. 
If an alarm user or an alarm equipment supplier violates or fails to comply with any provision of this chapter, such alarm user and such alarm equipment supplier shall hold the Village harmless from any cost, expense, claim or the like incurred or paid by the Village, including but not limited to reasonable attorney's fees, litigation expenses and court costs.
B. 
The alarm user and the alarm equipment supplier, by applying for a permit and by installing alarm systems within the Village, waive any claim or cause of action which either may have against the Village for acts or actions taken by the Village in good faith.

A. 
No person shall use, or cause or permit to be used, an alarm system utilizing signaling devices that automatically select a public trunkline of the Police or Fire Department and then reproduce any prerecorded message to report any robbery, burglary, fire, hazard or other emergency.
B. 
With the exception of local alarms, only signaling devices may be installed in the Village for the purpose of reporting any robbery, burglary, fire, hazard or other emergency to the Police or Fire Department.

The Police or Fire Department may contract for the installation of and maintain a signal board within the Police or Fire Department.

Local alarms with any externally audible alert shall not make a sound similar to that of civil defense warning systems. Such local alarms in residential districts must have an automatic cutoff at 10 minutes or less of sounding.

A. 
Any alarm user who has false fire alarms or malfunctions on more than three occasions in any one-year period shall be fined for each false alarm in excess thereof occurring within the same one-year period. The fine shall be in the amount of $100 for each of the next two false alarms and shall be in the amount of $150 for each false alarm thereafter.
B. 
Any alarm user who has false burglar or holdup alarms or malfunctions on more than four occasions in any calendar year shall be fined for each false alarm in excess thereof occurring within the same calendar year. The fine shall be in the amount of $25 for each of the next false alarms. False alarms which result from malfunction of the telephone system which connects the alarm to the central board shall not be charged as false alarm violations.
C. 
A fine shall be due and payable by the alarm user within five days after written notice of the violation. Any alarm user who does not pay a fine within the time prescribed, in addition to all other remedies, shall be subject to revocation of his permit pursuant to § 9-160.
D. 
All fines under this chapter shall be payable to the Clerk of the Village and deposited to the general fund.

A. 
Any person, firm or corporation who violates, disobeys, omits, neglects, refuses to comply with or who resists enforcements of any of the provisions of this chapter upon conviction shall be fined not less than $50 nor more than $500 for each offense. Each day that such violation is permitted to exist shall constitute a separate offense.
B. 
Any person violating any section of this chapter, in lieu of being charged for such violation in a court of competent jurisdiction, may pay to the Clerk, within five days after receiving notice of a violation, the sum of $25. If such amount is not paid within five days, such person shall be charged with the violation in accordance with law in a court of competent jurisdiction.
