A. 
Definition.
WOOD-BURNING DEVICES
Includes, but not be limited to, fireplaces, stoves, cooking equipment, outside wood burners, whether manufactured or homemade. Outdoor fireplaces shall be self-contained, manufactured, noncombustible units, supported off the ground by noncombustible legs, and shall be provided with a tight-fitting protective screen and/or lid which is to be used whenever the fireplace is in operation. Also permitted are approved fixed, permanent masonry fire pit structures. Not permitted are barrels, half barrels, drums or similarly constructed devices.
B. 
The use of outdoor fireplaces or wood-burning devices shall be permitted on the following conditions:
1. 
Fuels shall only be clean, dry, untreated wood or manufactured products designed for the specific purpose of wood burning. Treated wood, painted wood, leaves, garbage, paper or any other nonapproved product shall not be used.
2. 
Outdoor fireplaces and wood-burning devices shall be operated at all times under direct adult supervision. Proper fire extinguishing equipment shall be readily available.
3. 
The use of outdoor fireplaces or wood-burning devices shall be conducted in an area that does not present a danger to surrounding areas, structures or vehicles. Outdoor fireplaces or wood burning devices shall not be used within 20 feet of any building, structure, building overhang or vehicle.
4. 
The use of outdoor fireplaces or wood-burning devices which results in the escape of smoke, soot, cinders, noxious acids, fumes, gases, fly ash or dust in such quantities as to endanger the health of persons of ordinary sensibilities, or to threaten or cause substantial injury to or upon abutting or adjacent public or private property or that of another tenant, shall constitute a violation of this chapter.

Any person found in violation of this chapter shall be fined not less than $100 nor more than $750.
6. 
Outdoor fireplace or wood-burning device use shall be contingent upon compliance with the Code of the Village of Thornton, particularly those sections relating to fire prevention, health and nuisances. If upon inspection it is determined by a police officer, fire fighter, building inspector, code enforcer, or other Village official that a nuisance is being created, the operator may be directed to extinguish the fire and the failure to do so shall constitute a violation of this chapter.
