The purpose of this chapter is to set forth regulations, times of operations, and site maintenance procedures for construction and demolition sites within the City of Perth Amboy.
All permits, approvals and notices must be obtained or issued by the City of Perth Amboy Department of Code Enforcement prior to the commencement of any demolition or construction project.
The erection (including excavating), demolition, alteration or repair of any building shall occur between the hours of 7:00 a.m. and 6:00 p.m. on weekdays, and between the hours of 8:00 a.m. and 5:00 p.m. on Saturdays, except in cases of urgent necessity in the interest of public health and safety. In such cases a permit shall be obtained from the Department of Code Enforcement, and if unavailable, notice of the emergency shall be provided to the Police Department and at the next available business day a permit application shall be made for a period not to exceed three (3) days while the emergency continues. If the Department of Code Enforcement should determine that the public health and safety will not be impaired by the erection, demolition, alteration or repair of any building or excavation of streets and highways between the hours of 6:00 p.m. and 7:00 a.m., and if he shall further determine that loss or inconvenience would result to any party in interest, he may grant permission for such work to be done between the hours of 6:00 p.m. and 7:00 a.m. upon applications being made at the time the permit for the work is awarded or during the progress of the work.
No construction or demolition site shall permit the idle running of construction/demolition vehicles or machinery for more than five (5) minutes unless proven necessary for vehicle or machinery maintenance and care.
A. 
The public right-of-way shall be maintained and safe walking surfaces shall be provided to pedestrians at all times within the corporate limits of the City of Perth Amboy.
B. 
No construction or demolition site shall encumber or block any street, sidewalk, highway, or other public place with its construction/demolition vehicles or machinery.
C. 
If a construction or demolition site must affect the free flow of pedestrian public access to any street, sidewalk, highway, or other public place the contractor of the site must obtain approval for the encumbrance with the Department of Police and provide pedestrian traffic with a safe alternative walkway to reach the area blocked.
A. 
It shall be unlawful for any owner, agent or contractor in charge of a construction or demolition site to permit the accumulation of litter before, during or immediately following completion of any construction or demolition project. It is the duty of the owner, agent or contractor in charge of a construction site to furnish containers or dumpsters adequate to accommodate flyable or nonflyable debris or trash at areas convenient to construction areas and to maintain and empty the receptacles in such manner and with such frequency as to prevent spillage of refuse.
(1) 
All construction materials, demolition materials, equipment, vehicles and machinery shall be kept on-site, where applicable, and secured indoors, if such storage is accessible. Otherwise all materials, equipment, and machinery shall be stored outside in such a manner so as to prevent materials and debris from being disturbed by the elements and creating a hazard to the public.
(2) 
All loose construction and loose demolition debris shall be properly placed in on-site dumpsters and secured so as to prevent debris and materials from being disturbed by the elements and creating a hazard to the public. An owner, agent or contractor may choose to use off-site dumpsters but he/she must comply with the provisions set forth in Chapter 243, Article II.
B. 
For all single and two-family construction development sites, a six (6) foot high construction fence shall be erected to enclose the site. At the end of each workday this fence shall be properly secured from the public. At the end of construction this fence shall be removed by the contractor.
The following shall be exempted from the provisions of this section:
(1) 
Separate or single construction of a single or two-family structure.
(2) 
Single or two-family structure homeowners placing additions to an existing structure.
(3) 
Any interior construction or redevelopment.
(4) 
Large developments that apply for a waiver from the Department of Code Enforcement to enclose with a fence the areas of the development they are currently constructing upon.
C. 
At the end of every workday the owner, agent or contractor of any construction or demolition site shall have the responsibility of cleaning all areas within the site abutting and adjoining the pedestrian public right-of-way so as not to encumber the public access by tracking mud, dust or debris on any street, sidewalk, highway, or other public place. The owner, agent or contractor shall also keep the areas abutting and adjoining the right of public access free of all hazardous conditions to ensure a safe route of public access for the citizens of the City of Perth Amboy.
The Director of Public Works, the Department of Code Enforcement, the Director's designees, all sanitation inspectors, and all City of Perth Amboy police officers are authorized to issue summons for violation of any and all provisions of this chapter. Any person, firm or corporation who or which shall violate any of the provisions of this chapter shall be issued a notice of violation. If after twenty-four (24) hours of receiving this notice such person or entity has not complied with the provisions of this chapter any of the above empowered directors, departments, and designee's shall have the authority to stop and close all daily operations of the site until the person or entity in violation has complied with all the provisions of this chapter. In addition, upon conviction, any violator may be punished by one (1) or more of the following: imprisonment in the county jail or in any place provided by the municipality for the detention of prisoners for any term not exceeding ninety (90) days; a fine not exceeding one thousand dollars ($1,000) or by a period of community service not exceeding ninety (90) days; and each violation of any of the provisions of this chapter and each day the same is violated shall be deemed and taken as a separate and distinct offense.
