For the preservation and protection of human lives, public and private property, no person or persons, firm or corporation shall sell, use or possess what are commonly and commercially known as "fireworks," including everything that is designed and manufactured primarily for the production of pyrotechnic effects, excepting railroad signaling torpedoes and similar devices, within the corporate limits of the City of Perth Amboy.
For the purposes of this chapter, marbles coated with any explosive mixture, fireworks containing picric acid or pirates, colored fire, skyrockets, aerial bombs, pistols, cannons, canes or other appliances using blank cartridges or using caps containing chlorate of potash mixture, bombardments or mandarins made of chlorate of potash mixture, cartridge exploders and torpedoes shall be construed and defined as fireworks.
No permits or licenses of any kind shall be issued for the sale of fireworks at retail or use thereof within the corporate limits of the City of Perth Amboy.
The Police Department shall have the power to confiscate and destroy all fireworks prepared for retail sale or use in violation of this chapter.
Nothing contained herein shall be construed so as to interfere with the wholesale sale and storage of fireworks and the regulation thereof under and by virtue of any existing ordinance.
Nothing contained herein shall be construed to interfere with the use of fireworks in connection with any civic celebration under the sanction of municipal authorities of the City of Perth Amboy.

A Citizens Fireworks Committee is hereby established, consisting of five (5) members to be appointed by the Mayor to serve terms of five (5) years from January 1 of the year of their appointment. The Committee may organize and adopt rules for the conduct of its affairs and elect a Chairperson and Secretary from among its members. The Committee shall advise and consult with the Mayor or his designee with respect to its affairs, which shall be limited to activities related to organizing, coordinating and funding, through public and private sources. Fourth of July activities. The Chairperson shall be the representative of the City of Perth Amboy to any regional committee or commission established, and in which the City of Perth Amboy has agreed to participate, for the purpose of organizing, coordinating and funding regional Fourth of July activities. Nothing contained herein shall be construed as permitting the Citizens Fireworks Committee or any regional committee or commission to expend or obligate public funds without the consent of the City Council.

Any person or persons, firm or corporation violating any of the provisions of this chapter shall be fined not more than five hundred dollars ($500) for each and every offense or shall be punished by imprisonment not exceeding ninety (90) days for each and every offense, or both.
