A certain document, three (3) copies of which are on file in the Office of the City Clerk of the City of Perth Amboy, being marked and designated as the "International Property Maintenance Code 2015" as published by the International Conference of Building Officials, Building Officials and Code Administrators, and Southern Building Code Congress International, Inc., be and is hereby adopted as the Property Maintenance Code of the City of Perth Amboy, in the State of New Jersey, for the control of buildings and structures as herein provided. Each and all of the regulations, provisions, penalties, conditions and terms of said International Property Maintenance Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter with the additions, insertions, deletions and changes prescribed in Section
335-2 of this chapter.
The International Property Maintenance Code 2015 is amended
and revised in the following respects:
A. In Section 101.1 Title (page 1, second line, insert "City of Perth
Amboy."
B. In Section 103.1 General (page 2), add: "The Director of Code Enforcement
is hereby designated as the code official to exercise the duties and
powers of this code. However, said duties and powers may be exercised
by the Director's authorized representatives, including private
agencies, and employees of such agencies pursuant to contract with
the City of Perth Amboy."
C. Section 112.4 Violations shall read as follows:
Any person who shall violate a provision of this code shall,
upon conviction thereof, be subject to a fine of not less than one
hundred dollars ($100) nor more than two thousand dollars ($2,000)
or imprisonment for a term not to exceed ninety (90) days, or both,
at the discretion of the court. Each day that a violation continues
after due notice has been served shall be deemed a separate offense.
If the City chooses to impose a fine in an amount greater than
$1,250 upon an owner for violations of housing or zoning codes, it
shall provide a 30-day period in which the owner shall be afforded
an opportunity to cure or abate the condition and shall be afforded
an opportunity for a hearing before a court of competent jurisdiction
for an independent determination concerning the violation. Subsequent
to the expiration of the 30-day period, a fine greater than $1,250
may be imposed if a court has not determined otherwise, or, upon re-inspection
of the property, it is determined that the abatement has not been
substantially completed.
D. In Section 107.3(2) Method of Service (page 3) delete the word "certified"
from this section.
E. The following sections are deleted:
(1) Section 111.1, Means of Appeal, at Page 6.
F. In Section 304.14, Insect screens (page 13, lines 1 and 2), insert:
"July 1 to September 1."
G. In Section 602.3, Heat supply (page 21, fifth line), insert "October
15 to March 15."
H. In Section 602.4, Occupiable work spaces (page 21, third line, insert):
"October 15 to March 15."
