Whenever a local state of emergency within the City of Perth Amboy is declared, in accordance with appropriate laws and regulations promulgated by the State of New Jersey, emergency orders and emergency protective measures shall be implemented in the interest of public safety. These such orders may be necessary to implement and carry out emergency management operations and to protect the health, safety, and resources of the residents of the City of Perth Amboy. In accordance with N.J.S.A. A:9-40.4 and A:9-40.5, shall include but not limited to such actions as:
A. 
Issue of orders or proclamations regulating the hours during which persons shall be prohibited from remaining upon the public streets, ways and places in the City of Perth Amboy.
B. 
Issue orders or proclamations regulating the hours during which vehicular traffic shall be prohibited or restricted from traveling over the streets in the City of Perth Amboy.
Upon declaring that a state of disaster or emergency exists in the City of Perth Amboy, the Alert Warning and Communications annex of the Local Emergency Operations Plan shall be implemented including but not limited to the notification of outlets and utilize available appropriate alert warning and communication systems to announce that a state of disaster or emergency be broadcasted.
After a declared state of disaster or emergency exists in the City of Perth Amboy and resulted in an order or proclamation regulating the movements of persons or vehicles in or about the City of Perth Amboy or instituted other emergency protective measures, it shall be unlawful and a violation of this article for any person in the City of Perth Amboy to disobey any emergency protective measure put in place in the interest of public safety.
Any person who shall violate any of the provisions of an emergency protective measure order or proclamation issued by appropriate authorities during a declared local state of emergency shall, upon conviction thereof, be subject to a fine not exceeding $2,000 or be imprisoned for a term not exceeding 90 days, or both.
All ordinances or part of ordinances inconsistent with or in conflict with this article are hereby repealed to the extent of such inconsistency.
The provisions of this article are declared to be severable, and if any section, subsection, sentence, clause or phrase hereof shall, for any reason, be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses or phrases of this article, but they shall remain in effect, it being the legislative intent that this article shall stand notwithstanding the invalidity of any part.
This article shall take effect immediately upon passage, publication and approval according to law.
