Pursuant to Section 11 of the Uniform Fire Safety Act (P.L.
1983, c. 383), the New Jersey Uniform Fire Code shall be locally enforced
in the City of Perth Amboy.

The local enforcing agency shall be the Bureau of Fire Prevention,
which exists with the Fire Department of the City of Perth Amboy.
The local enforcement agency shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of the City
of Perth Amboy, other than owner-occupied one (1) and two (2) family
dwellings, and shall faithfully comply with the requirements of the
Uniform Fire Safety Act and the Uniform Fire Code.

A. The local enforcing agency established by Section
227-2 of this chapter shall be a part of the Fire Department of the City of Perth Amboy and shall be under the direct supervision and control of the Fire Official who shall report to the Chief of the Fire Department.

B. The local enforcement agency established by Section
227-2 of this chapter shall register and shall carry out annual inspections of all non-life hazard uses and certain storage facilities as required by the Uniform Fire Code. There shall be an annual inspection fee charged for each non-life-hazard use and storage facility inspected and re-inspected as required. The fees to be charged are listed in Section
227-9.

The local enforcing agency established by Section
227-2 of this chapter shall be a part of the Fire Department of the City of Perth Amboy and shall be under the direct supervision and control of the Fire Official who shall report to the Chief of the Fire Department.
Under N.J.S.A. 52:27D-206(b) and as provided for under N.J.A.C.
5:70-2.19 any person aggrieved by any order of the local enforcement
agency shall have the right to appeal to the Construction Board of
Appeals of Middlesex County.
In addition to the inspection and fees required pursuant to
the Uniform Fire Safety Act and the regulations of the Department
of Community Affairs, the following additional inspections and fees
shall be required: none.

The permit fees established by the Uniform Fire Code shall be
as per N.J.A.C. Section 5:70-2.9.
Fees to be charged for the annual inspection and re-inspection,
if required, of non-life hazard uses and storage facilities shall
be as follows:

(1) All businesses of Use Groups B, S1, S2, F1, F2, M and I which are
less than 400 square feet: $100.
(2) All businesses of Use Groups B, S1, S2, F1, F2, M and I which are
greater than 400 square feet but less than 2,500 square feet: $150.
(3) All businesses of Use Groups B, S1, S2, F1, F2, M and I which are
greater than 2,500 square feet but less than 5,000 square feet: $200.
(4) All businesses of Use Groups B, S1, S2, F1, F2, M and I which are
greater than 5,000 square feet but less than 8,000 square feet: $350.
(5) All businesses of Use Groups B, S1, S2, F1, F2, M and I which are
greater than 8,000 square feet but less than 12,000 square feet: $500.
(6) All businesses of Use Group B, and S2 which are greater than 12,000
square feet but less than 25,000 square feet: $800.
(7) All businesses of Use Group B and S2 which are greater than 25,000
square feet but less than 50,000 square feet: $900.
(8) All businesses of Use Group B and S2 which are greater than 50,000
square feet but less than 75,000 square feet: $1,000.
(9) All businesses of Use Group B and S2 of greater than 75,000 square
feet: $1,200.
B. Residential structures:
(1) One to two dwelling units, non-owner-occupied: $150.
(2) Three to four dwelling units: $200.
(3) Five to nine dwelling units: $250.
(4) Ten to 20 dwelling units: $300.
(5) Twenty-one to 30 dwelling units: $400.
(6) Thirty-one to 50 dwelling units: $500.
(7) Fifty-one and above: $600.
Re-Inspection Fee 25% of original fee for all Commercial Premises
& Residential Structures.

Non-life hazard inspection fees shall be paid within thirty
(30) days of the completed inspection. All fire code violations that
were issued penalties shall be paid for as stated in the notice of
violation. Failure to pay non-life hazard inspection fees within thirty
(30) days or to pay violation penalties as issued shall be fined two-hundred
dollars ($200). Continued failure to comply may result in fines up
to two thousand dollars ($2,000) and a summons to appear at the Perth
Amboy Municipal Court.
This Article shall be known as any may be cited as the "Firesafety
Ordinance."
