A. 
Required.

(1) 
Before any one- and two-family or attached single family structure is sold, leased, or otherwise made subject to a change of occupancy for residential purposes, the owner shall obtain a certificate of smoke alarm, carbon monoxide alarm, and portable fire extinguisher compliance CSACMAPFEC N.J.A.C. 5:70-2.3, evidencing compliance with N.J.A.C. 5:70-4.19, from the Perth Amboy Fire Prevention Bureau.
(2) 
The application fee for a certificate of smoke alarm, carbon monoxide alarm, and portable fire extinguisher compliance CSACMAPFEC N.J.A.C. 5:70-2.3, shall be as follows:
(a) 
Single-family: $100.
(b) 
Two-family: $150.
(3) 
A fee of $50 shall be paid for any re-inspection required as a result of any missing, out dated, or non-working life safety equipment or failure of the applicant or applicant's agent not being present for the inspection. In addition, any cancellation received less than 24 hours, shall be subject to the $50 re-inspection fee.
B. 
In dwellings having basements or cellars, an additional smoke detector shall be installed in the basement or cellar in a location approved by a fire inspector of the City of Perth Amboy.
C. 
The above-referred-to smoke detector shall be either an electrically operated smoke detector or a battery-operated smoke detector, approved by a fire inspector of the City of Perth Amboy as per code. Any such detector shall bear a seal, tested and listed by an approved rating organization, and shall comply in design to all applicable state, federal or industrial requirements and shall be operable.
D. 
No single-family or multifamily residential unit shall be sold, rented or have additions constructed thereto, unless and until the residential unit has been brought into compliance with Article.
E. 
The Tax Collector of the City of Perth Amboy shall provide each person requesting an official tax search, from his or her office, a statement calling attention to the provisions of this Article with respect to smoke detectors. The Tax Collector shall further inform the recipient of each and every tax search that the seller or lessor of real estate located in the City of Perth Amboy covered by this Article is required to obtain a permit application from the Fire Prevention Bureau for compliance with this Article. Applications shall be made to the Fire Official of the City of Perth Amboy, Fire Prevention Bureau, 375 New Brunswick Avenue, Perth Amboy, New Jersey together with the required fee payable to the City of Perth Amboy.

F. 
The application fees required for the inspection of the sale of one- or two-family residential properties for carbon monoxide detectors and fire extinguishers and also smoke detectors shall be found in Subsection A above.

G. 
Whenever the term "fire inspector" of the City of Perth Amboy is used in the within Article, it shall mean a fire inspector of the Fire Prevention Bureau and Perth Amboy Fire Department.

In addition to the penalties assessed pursuant to the Fire Prevention Code, any person, firm or corporation who shall violate any of the provisions of this Article shall upon conviction, be punished by one (1) or more of the following: imprisonment in the county jail, or in any place provided by the municipality for the detention of prisoners, for any term not exceeding ninety (90) days; or by a fine not exceeding two thousand dollars ($2,000); or by a period of community service not exceeding ninety (90) days; and each violation of any of the provisions of this Article and each day the same is violated shall be deemed and taken to be a separate and distinct offense.
