No person shall run, drive or propel, or cause to be run, driven or propelled over or upon any railroad track within the corporate limits of the City of Perth Amboy across any public street or highway of said city any locomotive engine or railroad cars of any description or railroad train at a greater rate of speed than ten (10) miles an hour; provided, however, that this chapter shall not apply to any railroad that has gates erected and in use across the streets of this city where its tracks cross such streets, nor shall it apply, after the erection of such gates, to railroad crossings at which gates are hereafter erected and maintained.
Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than five hundred dollars ($500) or by imprisonment for not more than ninety (90) days, or both, for each and every offense.
