There is hereby created a Parking Committee which shall consist
of the following individuals:
A. Director of Public Safety.
C. Chief of Police or his designee.
The permit issued shall be displayed and visible at all times
on the back side of the inside rearview mirror of the motor vehicle
for which the permit is issued, for ease of visibility.
All parking permits will be in force for the duration of three
years and will expire on December 31 of the year displayed on the
permit. All permit holders seeking renewals of their permit shall
make a new application for the overnight parking between September
1 and December 31 of the year of expiration. The Gloucester City Police
Department will investigate all permit renewals. If, at any time,
a portion of the driveway or garage or other legal off-street parking
area becomes available to a resident who has been granted a permit,
that permit shall become null and void and will not be eligible for
renewal.
If the Gloucester City Police Department investigation report
recommends the denial of the application, said applicant may appeal
in writing to the Gloucester City Parking Committee. The Police Department
shall have authority to issue temporary permission to said applicant
to park on the street overnight pending completion of the Parking
Committee review.
A. The Parking Committee shall review the applications forwarded to
it by the Police Department and render its decision within 15 days
of its receiving the application for review.
B. The Parking Committee shall conduct its review in any of the following
ways:
(1)
Personal investigation of the property and neighborhood of the
resident so as to be familiar with the physical conditions of the
property where the resident resides.
(2)
A personal interview with the applicant or review of any written
materials, drawings, photographs, surveys, etc., made available to
it by the applicant.
(3)
In those cases in which an applicant is seeking a permit where
two or more permits have already been issued to residents of the premises
and the Police Department's denial is based merely on the fact that
two or more permits have already been issued for said property, the
Parking Committee may summarily review the application and direct
the Municipal Clerk to issue said permit based on the original application
and police investigation establish that the property and premises
involved do not have sufficient off-street parking facilities for
the number of cars owned, leased or used by resident of that property
or premises.
C. All decisions recommending the denial of the issuance of a permit
by the Police Department or Parking Committee shall be mailed by ordinary
mail to the applicant, and the applicant may be notified by telephone,
within 48 hours of the decision.
Nothing shall prohibit the Parking Committee from directing
the Clerk to issue a permit to any resident who establishes the existence
of an unusual circumstance or hardship that renders the issuance of
a permit necessary even though there may be sufficient off-street
parking for residents; in a particular, but not limited to, those
individuals who are periodically called upon to use their vehicles
in emergency situations.
A motor vehicle with a valid permit affixed to the back side
of the inside rearview mirror shall be allowed to park on the street
where the owner and/or operator of said vehicle lives and preferably
in the immediate area in front of the owner's and/or operator's residence
between the hours of 7:30 a.m. and 7:30 p.m. or as otherwise provided
hereafter.
The provisions of this section notwithstanding, no motor vehicle
shall be permitted to be parked on any public street for more that
24 continuous hours, except where said motor vehicle displays a valid
parking permit and is parked in front of and to the driveway cut of
the residence of the person to whom said permit is issued.
The Police Department shall have the authority to permit temporary
overnight parking for visitors or guests of residents or if a vehicle
is temporarily disabled. Said permission may be granted upon a written
or oral request to the Police Department by a resident of the Township
or the operator of the motor vehicle that is to be parked on the street.
Said permission shall be for one night unless specifically authorized
by the Police Department for a greater period of time.
Any person obtaining a permit under false pretense, or using
said permit for other than residential purposes, or who transfers
said permit to another for use thereof, shall be guilty of violating
this section, and the penalty for violations of this section shall
be a fine not exceeding the threshold previously established by ordinance
or imprisonment for a period of 30 days and evocation of the parking
permit.
No person shall park a vehicle on the following streets or parts
of streets unless an appropriate and current parking permit, as issued
by the municipality, is displayed on said vehicle for the appropriate
street or part of a street as described or listed below:
