There shall be a Department of Administration and Finance, the
Director of which shall be the Business Administrator, who shall serve
the Township in a full-time capacity. The Department shall consist
of the Division of Administration, the Division of Recreation, the
Division of Finance, the Division of Revenue Collection, the Division
of Assessments, the Division of Police, the Division of Emergency
Management and the Division of Ambulance Services.

The Mayor shall appoint a qualified purchasing agent meeting
the criteria of N.J.A.C. 5:34-5.1. The qualified purchasing agent
is assigned the authority, responsibility and accountability for the
purchasing activity of the Township. His duties include, but are not
limited to, preparing advertisements, advertising and receiving bids
and recommending contract award to the Council.

A. Establishment; Division head; appropriate authority; duties of the
Chief of Police. There shall be a Division of Police, the head of
which shall be the Chief of Police. Pursuant to N.J.S.A. 40A:14-118,
the Mayor is the appropriate authority. The following titles and positions
shall exist within the Police Department: one Chief of Police, not
to exceed two Captains, not to exceed five Lieutenants, not to exceed
14 Sergeants and not to exceed 55 Patrol Officers. The Chief of Police
shall be directly responsible to the appropriate authority for the
efficiency and routine day-to-day operations, and shall, pursuant
to policies established by the appropriate authority:

(1) Administer and enforce rules and regulations and special emergency
directives for the disposition and discipline of the force and its
officers and personnel;
(2) Have, exercise and discharge the functions, powers and duties of
the force;
(3) Prescribe the duties and assignments of all subordinates and other
personnel;
(4) Delegate such authority as deemed necessary for the efficient operation
of the force to be exercised under the Chief's direction and supervision;
and
(5) Report at least monthly to the appropriate authority in such form
as shall be prescribed by such authority on the operation of the force
during the preceding month, and make such other reports as may be
requested by such authority.
B. Powers and duties of Division. The powers and duties of the Division
shall include but are not limited to the following:
(1) To preserve the public peace, protect life and property, prevent
crime, detect and arrest offenders against the penal laws and ordinances
effective within the Township, suppress insurrections, disperse any
unlawful or dangerous assemblage and preserve order at all elections,
public meetings and assemblages.
(2) To administer and enforce laws and ordinances which regulate, direct,
control and restrict the movement of vehicular and pedestrian traffic
and the use of the streets by vehicles and persons and which protect
the safety and facilitate the convenience of motorists and pedestrians
and to make and enforce appropriate rules and regulations for such
purposes.
(3) To remove or cause to have removed all nuisances in the public streets,
parks and other public places; investigate and observe all places
of public amusement or assemblage and all places of business requiring
any state or municipal licenses or permit; and report violations to
the appropriate department.
(4) To provide proper police attendance and protection at fires.
(5) To provide for the attendance of its members in court as necessary
for the prosecution and trial of persons charged with crimes and offenses
and cooperate freely with the law enforcement and prosecuting authorities
of federal, state and county governments.
(6) To operate a training and recruitment program to maintain and improve
the public efficiency of the members of the Division.
(7) To make studies of traffic conditions in the Township and recommend
to the Mayor such physical improvements and changes in the Township
ordinances as may be necessary or desirable to facilitate the safe
movement and control of motor vehicle traffic within the Township.
C. Mission. The Mission of the Division shall include, but not be limited
to the following:
(1) The Monroe Township Police Department's fundamental duty is to serve
the community, protect lives and property and to respect the constitutional
rights of all people to liberty, equality and justice.
(2) The Monroe Township Police Department shall maintain a strong law
enforcement focus through the active implementation of the rules of
law and by working with the community to improve quality of life.

A. Establishment; Division head; deputy; appointment. There shall be
a Division of Municipal Disaster Control, the head of which shall
be the Municipal Disaster Control Director. Pursuant to N.J.S.A. App.
A:9-40.1, the Mayor shall appoint the Municipal Disaster Control Director
from among the residents of the Township for a term of three years,
subject to fulfilling the requirements of N.J.S.A. App. A:9-40.1.
The Municipal Disaster Control Director shall appoint a Deputy Municipal
Disaster Control Director from among the salaried officers or employees
of the Township with the approval of the Mayor.
B. Duties. The Municipal Disaster Control Director shall be responsible
for the planning, activating, coordinating and the conduct of disaster
control operations within the Township.
C. Township Defense Council; establishment; duties. Pursuant to N.J.S.A.
App. A:9-41, there is hereby created a local defense council to be
known as the "Township Defense Council" which shall be composed of
not more than 15 members to be determined by the Mayor, which members
shall be appointed by the Mayor and shall hold office at the will
and pleasure of the Mayor. The Municipal Disaster Control Director
shall be a member and shall serve as Chairman of the Township Defense
Council. The Township Defense Council shall assist the Township in
establishing the various local volunteer agencies needed to meet the
requirements of all local civilian defense and disaster control activities
in accordance with rules and regulations established by the Governor.
The Township Defense Council is authorized within the limits of appropriations,
to establish an adequate organization to assist in supervising and
coordinating the civilian defense and disaster control activities
of the Township.

A. Establishment; appointment.
(1) There shall be established within the Department of Administration
and Finance, under the unit of Emergency Management Services of the
Police Department, the Division of Municipal Ambulance Service, the
head of which shall be the Director/ Emergency Medical Technician
who shall be appointed by the Mayor.
(2) There shall be established within the Division of Municipal Ambulance
Service an Administrative Task Force for emergency medical services
consisting of nine members, two of whom shall be Council members,
two of whom shall be municipal employees and five of whom shall be
citizens of the Township. All members shall be appointed by the Mayor
and shall serve at his pleasure. The Chairman shall be designated
by the Mayor. The Chairman shall be the power to appoint subcommittees
as he sees necessary. Liaison members of this Committee shall be the
Business Administrator, the Chief of Police, the Director of the Office
on Aging, the Director/Emergency Medical Technician of the Municipal
Ambulance Service and the Planner/Administrative Officer.

A. The New Jersey State Department of Health has issued licensure for
the Monroe Township Emergency Medical Services Program (the "Program")
administered by the Monroe Township Division of Ambulance Services
(the "Division"); and
B. The Program has been in operation providing experience and statistics
regarding the service and the patients served; and
C. The Division has applied for a "Provider Number" from the Federal
and State Medicare/Medicaid Programs, enabling the Township to institute
a third party payment plan (the "Payment Plan"); and
D. Most residents have an insurance plan or Medicare/Medicaid which
provides payments to relieve or to partially relieve their payment
obligations; and
E. It is in the best interest of the taxpayers of the Township of Monroe
to establish the Payment Plan and to establish a subscription membership
plan (the "Subscription Plan") in accordance with Health Care Finance
Administration Guidelines ("HCFA") so that taxpayers will not be responsible
for co-payments.
(1) The Director of the Division (the "Director") and the Chief Financial
Officer of the Township (the "CFO") in consultation with the Township
Insurance Specialist shall be responsible for the Plan's billing.
(2) The fee for service is initially set as $300 base, $7.50 per mile
and $60 for oxygen per trip.
(3) The Director and the CFO shall annually review the Plan's cost accounting
records. The CFO shall obtain the state-wide industry average.
(4) The CFO shall annually, no later than March 1, adjust the fee for
services as set forth in Subsection E.(2) herein pursuant to the recommendation
of the Director and the Insurance Consultant.
(5) The Subscription Plan shall be reviewed annually by the CFO and the
Subscription Plan allocation shall be adjusted in the following year's
budget in accordance with HCFA guidelines. The CFO and the Insurance
Consultant shall prepare a report to be filed with the Office of the
Township Clerk.
(6) A certified copy of this section shall be filed with the applicable
federal and/or state agencies.

A. The Division of Recreation may adopt suitable rules and regulations
for fee charges for recreational programs, for safety and conduct
of persons using recreational facilities and for peace and order at
public events, which rules and regulations and fee charges shall be
kept on file in the office of the Township Clerk and be provided to
those individuals who request to utilize recreational facilities and
participate in recreational programs.
B. The rules and regulations shall be submitted to the Township Council
by the Division of Recreation immediately upon their initial adoption
and thereafter on the occasion of any change being made thereto. The
Township Council shall have the right by resolution to amend the rules
and regulations provided it does so within 30 days of the submission
to it of the rules and regulations by the Division of Recreation.
The rules and regulations shall be effective on the thirty-first (31st)
day after submission. The date of submission shall be the date the
Division of Recreation files the rules and regulations or amendments
thereto with the Township Clerk.
C. The Division may charge and collect fees for recreation programs
in the name of and only for the use of the Municipality.

A. The recreation fees, which are per person charges unless otherwise
indicated, shall be as follows, except that the fee for resident senior
citizens shall be 50% of the normal fee, and nonresidents shall pay
two times the normal fee. For the purpose of this section, "senior
citizen" shall be defined as any person 55 years of age or older.
Any person whose primary residence is outside the Township shall be
deemed a nonresident, notwithstanding ownership of property in Monroe
Township, ownership of a business in Monroe Township or employment
by a corporation, company or business located in Monroe Township.

B. Refunds. Refunds will not be given after a program begins. Refunds
will be approved only if an activity is canceled or postponed, if
the location is changed or if a request for refund is made for personal
reasons, in writing, three business days before the program begins.
A processing fee of $5 will be charged for refunds requested due to
personal reasons.
C. Late fees. A late fee of $5 will be charged for registering for a
program after the registration deadline for that program.
D. Waiver of fees. Fees may be waived at the discretion of the Director
or his designee based on data supplied by a participant indicating
his or her inability to pay.

A. Application policies and procedures.
(1) Applications for the use of Township parks and/or recreation facilities
may be obtained at the Monroe Community Center, 120 Monmouth Road,
Monroe Township, New Jersey. Applications are required for organized
programs, games, contests, picnics, sports activities, and any other
organized gathering.
(2) Applications for the use of Township parks and recreation facilities
will only be issued to adults 21 years of age or older.
(3) Monroe Township residents, businesses/industries located in Monroe
Township and Township based organizations will receive priority consideration
in being allowed to use Township parks and recreation facilities.
The following shall be the order in which the Recreation Department
shall review applications for the use of Township facilities:
(a)
Recreation sponsored organization programs for Township residents.
(b)
Travel teams affiliated with the Township based organizations.
To be qualified as an affiliated team, a team roster is required with
all facility use applications. This roster must include the name and
home address of all travel team members. At least 80% of the travel
team roster shall be residents of Monroe Township. However, exceptions
to the 80% requirement may be authorized by the Township recreation
staff, but in no case shall the team be composed of less than 50%
Township residents. For the purpose of this roster requirement, recreation
program and travel team participants from the Borough of Jamesburg
shall be counted as Township residents so long as the Borough of Jamesburg
continues the sending-receiving relationship with Monroe Township
High School. Travel teams in existence before April 1, 2012 with rosters
in which less than 80% of the members are Township residents shall
be grandfathered, and the Recreation Department shall allow existing
nonresident participants to continue in the program until they are
no longer age eligible.
(c)
Nonaffiliated Monroe Township travel teams in existence before
April 1, 2012.
(d)
Nonaffiliated Monroe Township travel teams established after
April 1, 2012.
(e)
Other private and/or nonresident individuals or organizations
that are subject to a facility charge payable to the Township of Monroe.
(4) The availability of facilities and equipment shall be at all times
subject to the needs and requirements of the Recreation Department.
(5) The Recreation Department is solely responsible for the scheduling
of all Township recreation facilities. All efforts will be made to
maximize the usage of Township facilities.
(6) Every organization shall sign such contract(s) for the use of facilities
as shall be required and pay the specified rental charges, if applicable,
and fees at least seven days prior to the event.
(7) In the event of a cancellation, the organization shall provide seven
days notice to the Recreation Department.
(8) All formal organizations using Township recreation facilities shall
furnish the Recreation Department with a copy of their bylaws and
their annual financial statements.
(9) The Township reserves the right, at its sole discretion, to deny
the use of any Township facility if the requested use is not in the
public interest.
B. Supervision. Each organization granted permission to use Township
parks and facilities shall provide responsible adult supervision.
C. Maintenance of facilities.
(1) Township facilities must be left in a clean and orderly manner. Applicants
granted the use of Township parks and recreation areas will be held
responsible for property damage resulting from the lack of adequate
supervision of participants and spectators. Users who damage Township
property shall be notified in writing by the Recreation Department
within 24 hours after the conclusion of the event, and the cost of
damage repair shall be billed to the user.
(2) Sports fields need to be rested for maintenance purposes as determined
solely by the Township Parks Department.
(3) The Township Recreation Department has the right to determine if
Township fields are playable.
(4) Whenever an event requires a Park and Recreation employee to be on
duty outside of regular working hours, or if additional work is needed
to prepare for an event or to clean up after the event, the Department
may charge a fee for such extra services.
(5) Vehicles used for field maintenance (e.g. golf carts used to rake
in-fields) shall only be operated by persons at least 18 years of
age with a valid New Jersey driver's license.
D. Request for new or modified facilities.
(1) Any organization wishing to improve and/or modify Township recreational
facilities at its own expense must submit a detailed plan of the proposed
improvement and a certificate of insurance to the Recreation Director.
(2) No such plan can be implemented without the prior written approval
of the Recreation Director and the Business Administrator.
E. Prohibited activities.
(1) The consumption of alcoholic beverages is prohibited in all Township
facilities.
(2) Smoking is prohibited in all municipal buildings, and to at least
20 feet away from the exterior of all municipal buildings. Smoking
is restricted to designated smoking areas in Township parks and outdoor
facilities.
F. Parking.
(1) Parking is limited to designated parking areas.
(2) No motor vehicles are permitted on any field, park, or open space
except in emergency situations only.
G. Insurance requirements for formal organizations.
(1) Formal organizations are defined as those organized as a 501C(3)
organization, or any corporation, professional corporation, limited
liability corporation, partnership, limited liability partnership,
sole proprietorship, joint venture, or any other business entity.
(2) Approval for the use of Township recreation facilities is specifically
contingent on the organization furnishing a copy of a Certificate
of Insurance naming the Township of Monroe as an additional insured,
and a letter of acknowledgment from the insurance agent/broker. The
Certificate shall be in an amount not less than $1,000,000 combined
single limit and shall include Comprehensive General Liability with
the Broad Form Liability endorsement or its equivalent. Failure of
the organization to provide a copy of a valid Certificate of Insurance
will render the application invalid and prohibit the use of the facilities.
(3) Recreation Accident Insurance. The Township provides, at its expense,
a Recreation Accident Insurance for all program registrants. The policy
provides for a maximum benefit of $1,000. It is intended to be supplemental
to your own personal health insurance. Eligible expenses will be determined
after benefits have been paid by the registrant's health insurance
carrier. All accidents must be reported within 24 hours after its
occurrence.
H. Enforcement.

(1) The
Township of Monroe Police Department shall have primary responsibility
for enforcement of the policies and procedures for the use of the
Township's recreation facilities.
(2) Any
person violating or failing to comply with any of the provisions of
this article shall, upon conviction thereof, be punishable by a fine
of not more than $2,000 or by imprisonment for a term not to exceed
90 days, or by both such fine and imprisonment, in the discretion
of the Judge. The continuation on each successive day shall constitute
a separate offense, and the person or persons allowing or permitting
the continuation of the violation may be punished as provided above
for each separate offense.

A. The Recreation Advisory Board shall consist of 11 voting members,
all of whom shall be residents of the Township. Two members shall
be appointed from each of the three wards (Ward I, II and III) within
Monroe Township, one member shall be appointed from the Township Council,
one member from the Board of Education and three at-large members.
The members shall be appointed by the Mayor and shall hold office
at the will and pleasure of the Mayor. A Chairman shall be appointed
by the Mayor from among the members. For purposes of budget, personnel
and purchasing, the Recreation Advisory Board is allocated and assigned
within the Division of Recreation. The Director of Recreation shall
be an ex-officio member.

B. The Board shall advise and make recommendations to the following
agencies and officials:
(1) The Division of Recreation and the Mayor, concerning or relating
to the administration of the recreation program.
(2) The Superintendent of Schools and the Board of Education, concerning
or relating to the facilities and equipment of the school systems.
(3) The Council, concerning or relating to matters of policy affecting
recreation.
C. Liaison representatives. There shall be 13 non-voting liaison representatives
to the Recreation Advisory Board, all of whom shall be appointed by
the Director of Recreation and shall hold office at the will and pleasure
of the Director of Recreation. One liaison member shall be appointed
for each of the following categories:

(3) High school: this representative is to be a high school student.
(8) Environmental Commission.
(9) High school athletic department.

A. Within the Department of Administration and Finance there shall be
a Division of Finance, the head of which shall be the Chief Financial
Officer of the Township.

B. The Chief Financial Officer will operate under the direction of the
Director of the Department of Administration and Finance and will
perform such duties as required by statute and as periodically assigned.
C. The Division shall:
(1) Maintain the central books of accounts of the Township according
to such forms, standards and procedures as shall be prescribed or
approved by the Business Administrator. Any and all Township officials
shall, upon request of the Chief Financial Officer, place at his/her
disposal, all records, books, bonds, documents and papers which he/she
may deem necessary to aid in his/her duty of keeping such accounts.

(2) Enforce a uniform system of accounts for all departments of the Township.
(3) Preaudit all payrolls, claims and demands against the Township upon
certification by a department head that the amount is due and unpaid,
according to the records and information of his department.
(4) Require that reports of receipts and disbursements from each department
of the Township be made in accordance with state statute.

(5) Maintain a central payroll system and all social security, pension
and pertinent data for same.
(6) Control all expenditures to assure that budget appropriations are
not exceeded and pass upon each proposed expenditure in conformity
with the Charter and the ordinances of the Township. Unless the division
head shall certify that there is an unencumbered balance of appropriation
available, no appropriation shall be encumbered and no commitment
or expenditure shall be made.
(7) Keep records and books of accounts for the exercise of the foregoing
financial budgetary control over each department of the Township and
keep such accounts as will show the amount of each appropriation,
the accumulative amount paid therefrom and the unpaid obligations
and unencumbered balance thereof.
(8) Prepare such statistical studies and reports as may be required by
other departments, divisions and bureaus, with the approval of the
Mayor.
(9) Deposit all funds received by the bureaus in such depositories as
designated by the Cash Management Plan Resolution of the Council.
All moneys of the Township not required for current operation shall
be invested pursuant to law or shall be deposited in interest-bearing
accounts. All such interest shall be accounted for in the Township
books of account.

Have custody of all investments and invested funds of the Township
or in its possession in a fiduciary capacity, except as otherwise
provided by law, and have the safekeeping of all bonds and notes for
transfer, registration or exchange.
(11)
Receive and safely keep and disburse moneys received and raised
for public schools and keep separate accounts thereof.
(12)
Keep a full and systematic account of all cash receipts and
disbursements in proper books. The Chief Financial Officer shall,
at least every month and more often if the Council requires, furnish
the Council, through the Mayor, with a statement of all moneys received
and expended by him/her, including school moneys, subsequent to his/her
last report. The Chief Financial Officer shall annually, during the
month of January, make a full report to the Council of his/her receipts
and expenditures during the preceding year and shall, whenever required,
lay before the Council, for examination or audit, all books, papers
and vouchers pertaining to his/her office.

No bill or claim shall be paid except in conformity with this
section.
A. No bill or claim shall be paid unless it contains a detailed statement
of the items or demand, specifying particularly how the bill or demand
is made up, and a certification of the party claiming payment that
it is correct; nor shall any bill, claim or demand be paid unless
the voucher has attached to it a certification of a department head,
or his duly designated representative, having personal knowledge of
the facts, that the goods have been received by or the services rendered
to the Township and that those services or goods are consistent with
any existing contract. For purposes of this section only, where any
office, position, board or agency is not included in an administrative
department, certification by the department shall be by the Administrator.
B. Bills, claims and demands against the municipality shall be deemed
approved or disapproved in accordance with the procedure prescribed
by this subsection. A voucher on a form prescribed by the Chief Financial
Officer shall be paid only upon the approval of the Chief Financial
Officer and Administrator. Disbursements shall be made by a check
or draft signed by the Mayor or, in his absence, the Administrator
and countersigned by the Chief Financial Officer; except that payroll
checks may be signed by the Chief Financial Officer, upon certification
by the Administrator of the total payroll.

C. All of the signatures required on a check may be inscribed mechanically.
D. List of bills, claims and vouchers.

(1) The Chief Financial Officer shall prepare for each agenda meeting
of the Township Council a list of all bills, claims and vouchers,
by voucher claim number, claimant and amount, submitted for payment
and received by that office as of 72 hours prior to the Council agenda
meeting. In addition, the Chief Financial Officer shall make available
at each agenda meeting, for perusal by the Council, each bill, claim
and voucher presented on said list. This list, which is presented
at the agenda meeting, shall constitute the list for payment of claims
by the Council at its next regular meeting. Such list, and addendum
bill list, if any, shall be made a part of the minutes of the meeting
and shall be prepared in sufficient quantities to supply each member
of the Council, the Mayor and Business Administrator with at least
one copy. A copy shall be filed with the Clerk as a public record
open to examination in his/her office. The list shall be submitted
to the Council for approval before any bill is paid. No claim for

A. Within the Department of Administration and Finance there shall be
a Division of Revenue Collection, the head of which shall be the Tax
Collector.
B. The Tax Collector will operate under the direction of the Director
of the Department of Administration and Finance and will perform such
duties as required by statute and as periodically assigned.
C. The Division of Revenue Collection shall:
(1) Receive and collect all current and delinquent real and personal
property taxes and charges, receive penalties and interest pursuant
to law and account for all collections in such form and manner and
at such times as may be prescribed or approved by the Chief Financial
Officer.

(2) Make or cause to be made and certify searches for taxes and other
liens on real property in the Township as may be authorized by law,
and charge and collect for the use of the Township the fee required
pursuant to law for any such search.
(3) Perform the functions of a collector of taxes under general law,
including, without limitation thereto, the preparation and mailing
of tax bills and the maintenance of tax accounting records in such
manner as may be prescribed or approved by the Chief Financial Officer;
and assist the Bureau of Assessments in the preparation of the annual
tax list and duplicate.

(4) Deposit daily, to the credit of the Township, all moneys received,
in one or more depositories as approved within the Cash Management
Plan Resolution adopted by the Council; maintain full and complete
records and accounts of all sums collected and received according
to such procedures and system as may be prescribed or approved by
the Chief Financial Officer; and make such monthly reports and accountings
of the funds of the Township collected, received and deposited and
may be required, which reports and accountings shall be filed as a
public record with the Township Clerk.

A. Within the Department of Administration and Finance there shall be
a Division of Assessments, the head of which shall be the Tax Assessor.
B. The Tax Assessor will operate under the direction of the Director
of the Department of Administration and Finance and will perform such
duties as required by statute and as periodically assigned.
C. The Division shall:
(1) Value all real property in the Township for the purpose of assessments
and taxation in accordance with general law, the Charter and ordinances;
exercise all the powers of a municipal Assessor pursuant to law; and
perform such other duties as prescribed by the Mayor and Council.
(2) Prepare the tax lists and duplicate as required by law and maintain
adequate records of each and every parcel of real property assessed
or exempted.
(3) Have custody of and maintain an up-to-date Township Tax Map and provide
for the recording thereon of all changes in ownership or character
of property assessed.
(4) Perform all other functions and duties required of Tax Assessors
by general law.

A. Within the Department of Administration and Finance there shall be
a Division of Library Services, the head of which shall be the Township
Librarian.
B. The Township Librarian will operate under the direction of the Director
of the Department of Administration and Finance and will perform such
duties as required by statute and as periodically assigned.
C. The Division shall:
(1) Carry responsibility for operation of any public library located
within the Township.
(2) Oversee the maintenance of each library building and its surrounding
grounds.
(3) Prepare reports on the progress and needs of the public library.
(4) Select, order, catalog and maintain the library's collection of books
and other materials.
(5) Perform such other duties as the Township Council may prescribe.
D. The Township Librarian shall hold a Masters in Library Science Degree
from an accredited institution and shall hold a New Jersey State library
certification.

A. Within the Department of Administration and Finance, there shall
be a Division of Senior Services which shall consist of an Office
of Senior Services which shall be the Director/Outreach Coordinator
of the Office of Senior Services.
B. The Director/Outreach Coordinator of the Office of Senior Services
will operate under the Director of the Department of Administration
and Finance and will perform such duties as required by statute and
as periodically assigned. The Director shall submit annually, for
the consideration of the Mayor and Council of the Township of Monroe,
a proposed budget for the Office of Senior Services.
C. The Division through the Office of Senior Services shall:
(1) Offer services to senior members of the Monroe community;
(2) Maintain a senior center to provide such activities as classes, lectures,
luncheons, crafts, and other activities;
(3) Provide for senior transportation within Monroe pursuant to N.J.S.A.
40:48-4.10;
(4) Perform such other duties as the Township Council may prescribe.

A. Establishment. Within the Department of Administration and Finance,
there shall be established the position of Municipal Public Defender.
The Municipal Public Defender shall be appointed by the Mayor with
the advice and consent of the Township Council for a term of one year.

B. Powers and duties. The Municipal Public Defender shall defend those
indigent individuals who are entitled by law to appointment of counsel
in matters coming before the Municipal Court of the Township. The
Municipal Public Defender shall furnish representation only in the
Municipal Court and not in connection with any appeal from proceedings
in the Municipal Court.
C. Compensation. The Municipal Public Defender shall be compensated
on a per case basis at a rate which shall be determined by the Mayor
with the advice and consent of the Township Council. The appointment
of the Municipal Public Defender and the setting of his compensation
shall be memorialized in a resolution enacted by the Township Council.
D. Fee for representation. Every person applying for representation
by a Municipal Public Defender shall, on approval of his or her application,
pay an application fee as set forth in C.2A:158-14 of the Municipal
Court Public Defender Law and in the guidelines promulgated by the
New Jersey Supreme Court. The Municipal Court may waive the required
application fee, in whole or in part, if the Court determines, in
its discretion, that the application fee represents an unreasonable
burden on the person seeking representation.

E. Annual report. A report shall be made and submitted annually by the Municipal Public Defender on or before February 15th on the operation of the Public Defender for the prior calendar year. The report shall include: a) the number of cases in which the Public Defender is appointed; b) the cost to the Township for the services of the Public Defender; c) the revenue received from fees collected pursuant to Subsection
D of this section; and d) recommendations with regard to the operation of the Municipal Public Defender System. Township Council will review the operation of the Public Defender System on or before July 1 of every year to determine whether to continue the system.

A. Establishment. Within the Department of Administration and Finance
there shall be established the position of Local Historian. The Local
Historian shall be appointed by the Mayor and shall serve for a term
of four years.
B. Powers and responsibilities. Pursuant to N.J.S.A. 40:10A-4 the local
historian shall have the following powers and responsibilities:
(1)
To carry out an historical program, including but not restricted
to collecting, preserving and making available materials relating
to the history of the local unit. The Historian shall store such materials
in such manner as to insure their preservation, and shall notify the
State Archivist, New Jersey Historical Commission, county local historian
and local governing body of any materials which should be acquired
for preservation. Upon leaving the position, the Local Historian shall
turn over all materials and records and reports into the position
of the successor, if then appointed, or to the governing body until
a successor shall be appointed.
(2)
The Local Historian shall make an annual report to the Chief
Executive Officer and governing body of the local unit stating all
the work performed and accomplished during that year. The Local Historian
shall transmit a copy of such report to the New Jersey Historical
Commission. The New Jersey Historical Commission may advise each municipal
historian of general guidelines along which their historical program
may be implemented.
(3)
The Local Historian may research, write and cause to have published
a municipal history, and may recommend appropriate historical materials
for publication.
(4)
The Local Historian may assist a landmark commission, as well
as advise the governing body, concerning the acquisition, administration,
use and disposition of any landmark, or historic site, including such
places in his jurisdiction included on the New Jersey Register of
Historic Places. Such advice may be furnished to the Historic Sites
Section, Department of Environmental Protection.
(5)
The Local Historian shall assist in projects of commemoration,
including the erection of monuments, historic markers and guide signs.
