The standards established and adopted by this chapter are described and commonly known as the "Standards for the Construction of Individual Subsurface Sewage Disposal Systems," all as set forth in N.J.A.C. 7:9-2.1 et seq., 1978.

Three copies of the Standards for the Construction of Individual Subsurface Sewage Disposal Systems have been placed on file in the office of the Township Clerk upon the introduction of this chapter and will remain on file in said office for use and examination by the public.

A. 
The language of Section 7:9-2.60(a) of the Standards for the Construction of Individual Subsurface Sewage Disposal Systems is deleted in part to read as follows:
Two percolation tests shall be performed at the site of each disposal field: one test in each of said disposal field limits, and one test in the center of said disposal area. Preliminary tests for tracts involving more than one disposal system must include one test per lot or as prescribed by the administrative authority ... [The balance of Section 7:9-2.60(a) to remain unchanged].
B. 
Applications for individual sanitary disposal systems proposing a raised bed design shall be reviewed and approved by the Monroe Township Department of Health and Welfare, which Department shall consider New Jersey Department of Environmental Protection and United States Environmental Protection Agency recommendations and data as well as existing site conditions.

Domestic garbage grinder units are not permitted in areas served by individual sewage disposal systems.

No person shall locate, construct or alter any individual sewage disposal system until a permit for the location, construction or alteration of said sewage disposal system shall have been issued by the Monroe Township Department of Health and Welfare.

New individual disposal systems shall not be placed in operation, nor shall new dwellings or buildings or additions thereto be sold or occupied which must rely on such a system for sewage disposal, until the Monroe Township Department of Health and Welfare shall have issued a certificate indicating that said disposal system has been located and constructed in compliance with the terms of the permit issued and the requirements of the aforesaid code. Issuance of such certificates shall also be required for alterations to an existing individual sewage disposal system.

In case any permit or certification required by this chapter is denied by the Monroe Township Department of Health and Welfare, a hearing shall be held thereon before the Township Council at the next regular Council meeting after request therefor is made by the applicant, and upon such hearing the Township Council shall affirm, alter or rescind the previous determination and take action accordingly within 45 days after the date of such hearing.

The Monroe Township Department of Health and Welfare may order all further work in and about any individual sewage disposal system which is being erected or installed in violation of the code to be stopped forthwith, except such work as shall be necessary to remedy such violation, and thereafter the work continued without any violation of any of the provisions of the code, and after issuance of any such order and the service of a copy thereof upon any person connected with or working in and about the erection or installation of any such disposal system or any part thereof, no further work shall be done thereon except as aforesaid.

The following fees and charges are herewith established:
A. 
For the filing of an application and plans and the issuance of a permit to locate and construct an individual sewage disposal system: $50.
B. 
For the filing of an application and plans and the issuance of a permit to alter an existing individual sewage disposal system: $10.

Applications for the construction of individual sewage disposal systems must be submitted and a permit obtained within one year from the date of the percolation test. Such a permit shall be valid for a period of two years from the date of the percolation test. A permit so issued by the Township shall not be transferable.

Any person or persons, firm or corporation violating any of the provisions of or any order promulgated under this chapter or the Standards for the Construction of Individual Subsurface Sewage Disposal Systems made a part hereof shall, upon conviction thereof, be subject to a penalty of not more than $500 or imprisonment for a period not exceeding 90 days, or both, for each violation period. Each day a particular violation continues shall constitute a separate offense.
