[1943 Code § 211.01]
There is hereby created and established a department of the
municipal government of the Village which shall be known as the fire
department and which shall consist of a fire marshal, such paid members
of the department as the President and Board of Trustees may, from
time to time, authorize and direct, a secretary, a treasurer, and
the members of the Elmwood Park volunteer fire department.

It shall be the duty of the fire marshal, in conjunction with
the board of fire and police commissioners to prescribe such rules
and regulations for the governing of the fire department as they shall
deem expedient for the welfare and efficiency of such department.

The Village does hereby establish as its personnel policy for
applicants for the position of firefighter, the following:
(a) All applicants for the position of firefighter must be a citizen
of the United States and must be a resident of the state for at least
one year immediately preceding the date of examination for such position.
(b) All applicants for the position of firefighter must meet the reasonable
limitations as to health, habits and moral character, as established
by the board of fire and police commissioners of the Village.
(c) All applicants for the position of firefighter must possess a high
school diploma or an equivalent high school education, and must meet
the qualifications for such position as established by the board of
fire and police commissioners of the Village.
(d) In addition to the minimum educational qualifications required by
Illinois state statute and/or other sections of this Code, applicants
for the position of firefighter shall have either: 1) completed a
minimum of 60 semester hours of college credit from a college or university
accredited in the state where such college or university is located,
or 2) served as a paid on call firefighter for the Village for a minimum
of two years. Courses from a trade school and/or technical school
are not applicable toward the required college credit. The final decision
on acceptable college credits shall be at the discretion of the board
of fire and police commissioners.
(e) All applicants for the position of firefighter must be a certified
emergency medical technician - basic (EMT-B) by the state of Illinois
at the time that such application is made, and also on the date of
hire.
(f) No person shall be appointed to the fire department unless he is
a person of good character, not a habitual drunkard, gambler, or a
person who has been convicted of a felony or a crime involving moral
turpitude.
(g) The names of candidates for original appointment for the position
of firefighter shall be stricken after such names have been on the
original appointment eligibility list for more than three years.

As a condition of employment, a successful applicant shall be
required to reside in the geographical area described as Cook, DuPage,
Kane, Will, Lake and McHenry Counties, in Illinois, within six months
of being sworn as a probationary firefighter, or as such time period
may be extended by the board of fire and police commissioners. Continued
residence within such geographical area shall be a condition of employment
throughout the firefighter's service with the Village. All firefighters
whose employment is subject to a collective bargaining agreement with
the Village shall be required to reside within the geographical area
described in such collective bargaining agreement, as amended from
time to time.

There is hereby created the office of fire marshal. He shall
be appointed by the Village Manager. The fire marshal shall, before
entering upon the duties of this office, take and subscribe the oath
prescribed by law for Village officers.

The fire marshal shall be the head of the fire department, and
subject to supervision by the Village Manager, shall have full command
and control of the fire department and over all members thereof, all
fire apparatus and equipment belonging to the Village. He shall see
that all fire apparatus and equipment is kept in good condition.
It shall be the special duty of the fire marshal to see that
all ordinances of the Village having any relation to the protection
from fire of life or property of the Village or relating to the fire
department, are strictly enforced, and that all members of the fire
department are faithful in the discharge of their duties.

The fire marshal shall attend at all fires occurring within
the Village and take command of the organization. With the concurrence
of the President or any three Trustees, the fire marshal may order
the tearing down and removal of any building, or may direct the blowing
up of any building, when in either case it shall be deemed necessary
to check the progress of any fire.

It shall be the duty of the fire marshal to visit and examine,
or cause the same to be done, all places reported to him as being
liable to cause or occasion the breaking out or spread of fire, and
to make such orders in relation thereto as the protection of life
and property may require.

The fire marshal shall annually, at the close of each fiscal
year, make a written report to the Village Manager, showing the condition
of the department under his management, together with a complete list
of fires occurring in the Village during the preceding year, the date
and location of each fire, the name of the owner of the property destroyed,
the cause of the fire, the loss incurred thereby, amount of insurance,
and such further information as he may deem important to the Village.

Upon expiration of his term of office or his resignation thereof,
or removal therefrom, the fire marshal shall, on demand, deliver to
his successor in office all books, records, equipment and property
of every description in his possession belonging to the Village or
appertaining to his office.

It shall be the function and duties of the fire department and
every member thereof to extinguish accidental or destructive fires,
to prevent the occurrence or spread of fires, to enforce all ordinances
relating to the occurrence or spread of such fires.
In case of fire, the fire marshal and his assistants, in their
order of rank, shall take command at such fire, and the officer highest
in rank shall take command of the fire department and direct the management
thereof for the suppression of the fire in the best manner possible.

The fire marshal may, either upon his own knowledge or upon
information communicated to him by others, prefer charges to the board
of fire and police commissioners against any member of the fire department
for incompetency, neglect of duty, disobedience of orders or violation
of any of the standing rules or regulations of the department.

Every male person above the age of 21 years who shall be present at a fire shall be subject to the orders of the officer in command at such fire and shall render all the assistance in his power, and in such a manner as he may be directed, in the extinguishment of the fire and in the removal of and protection of property, and any person refusing to older such orders shall upon conviction, be punished as provided in Section
13-3, provided no person shall be bound to obey any such officer, unless such officer's official character shall be known or made known to such persons.

There shall be paid as compensation to each member of the volunteer
fire department attending a fire by making a call on an alarm with
the apparatus of the fire department a sum to be determined by the
President and Board of Trustees for each fire or call made.

It shall be the duty of all officers of the fire department
and all police officers of the municipality to see that the provisions
of this article are enforced and to arrest on view any person who
shall be found violating any of the provisions of this article or
who shall hinder, resist or refuse to obey any such officer in the
discharge of his duty, and to that end all such officers are hereby
vested with the usual power and authority of police officers.

It shall be unlawful for any person wilfully to hinder, delay
or obstruct any officer or fireman in the performance of his duty
at or while going to a fire, wilfully to destroy any engine or fire
apparatus of the Village, or damage the same, or to drive a vehicle,
railroad train, engine, car or any kind of conveyance or vehicle over
any unprotected hose of the Village when laid down in any street,
alley or elsewhere, for use at a fire.

It shall be unlawful for any person to use any fire engine,
hose, cart, or any other apparatus, belonging to the municipality
for any private purpose, other than the extinguishment of fire or
to remove the same or any part thereof from its place or deposit,
or having the control thereof to permit such engine, hose, cart or
other apparatus to be used for any private purposes.

No person without reasonable cause, by outcry or otherwise,
shall make or circulate, or cause to be made or circulated, any false
alarm of fire within the Village.
