No person, groups of people, business firm or
corporation shall offer for sale any live, nonartificial Christmas
trees, holly, wreaths, grave blankets, etc., within the Township of
Nutley without first obtaining a permit from the Municipal Building
Inspector.
Permits for the sale of the aforementioned Christmas
trees, holly, wreaths, grave blankets, etc., shall be restricted to
areas zoned for business and be in accord with all zoning regulations
pertaining thereto; except that houses of worship shall be permitted to sell
Christmas trees, holly, wreaths, grave blankets, etc., on their own
premises and for their own charitable benefit. Applicants for a permit
shall obtain a certificate of approval of the business site and merchandise
to be sold thereon from the Municipal Fire Department, which shall also certify that the applicant will conform
to all applicable Fire Department laws, ordinances and regulations, and present said certificate to the Building Inspector
before a permit shall be issued.

A fee of $25 shall be charged to obtain a permit.
In addition, the applicant shall deposit the sum of $25 with the office
of the Construction Official in order to guarantee that any remaining
Christmas trees and/or debris remaining from the sale and handling
of the trees, holly, wreaths, grave blankets, etc., shall be cleared
away and removed not later than two weeks after Christmas day. In
the event the licensee fails to remove any remaining trees and debris
by the aforesaid date, then the clearing away and removal shall be
performed by the Public Works Department of the municipality, with
any expenses incurred charge against the deposit sum.
All aforementioned Christmas trees, holly, wreaths,
grave blankets, etc., offered for sale shall be treated so as to be
rendered fireproof and nonflammable.
No open fires shall be permitted on any site
approved for the sale of Christmas trees during the period that said
trees are either stored or sold at said location.

Any person violating the provisions of this
chapter shall, upon conviction thereof, be subject to a fine not to
exceed $500 or imprisonment for a term not exceeding 90 days, or both.
