The Water Department in the Township of Nutley, County of Essex, New Jersey, is hereby established and shall be operated under the following rules and regulations, and its relations with consumers of water are herein defined.[1]

The Water Department of the Department of Public Works (hereinafter referred to as "Water Department") shall have charge of the distribution system, its maintenance and operation, design and construction of extensions and renewals and the purchase of water.

All the executive, administrative, judicial and legislative powers for the Water Department are hereby assigned to the Department of Public Works, and the Municipal Engineer shall be held responsible for the prompt and efficient exercise of such administrative duties.

There is hereby assigned to the Department of Revenue and Finance the duty of keeping a correct account of the Water Department as prescribed by law, and the Department of Revenue and Finance shall have charge of all billing and collecting of accounts.
The cost of work performed by the Department of Revenue and Finance and by the Department of Public Works for the Water Department shall be determined by the Board of Commissioners and set forth in annual budgets.
