All landscapers utilizing a truck, van or trailer for landscaping services within the Township of Nutley shall be required to obtain a license in order to offer their services in the Township of Nutley. A license shall be required for each vehicle the landscaper owns or operates within the Township of Nutley. Said license shall be obtained from the Department of Public Works prior to October 1 of each calendar year and shall expire on September 30 of the subsequent year. Proof of license will be demonstrated by the issuance and the display of a decal, which will be issued to each licensee and displayed in each vehicle the landscaper owns or operates in the Township of Nutley.
A. 
All applications for landscaping licenses shall be in writing on all forms furnished by the Township, signed by the applicant or the authorized agent of the applicant, and presented to the Department of Public Works. The application shall state:
(1) 
The name of the landscaper.
(2) 
The correct name under which the business is being operated.
(3) 
The residence of the applicant.
(4) 
The addresses of the residents of the Township for whom landscaping services are being provided; and
(5) 
Such other pertinent information as may be necessary for an investigation of the applicant.
B. 
All applications for licenses received by the Department of Public Works shall, after appropriate investigation, be presented by the Department of Public Works to the Superintendent of the Department of Public Works, who shall either grant or refuse the application. Thereafter, if the application is approved, the Department of Public Works shall issue the license upon a payment of the license fee as hereinafter provided. All licenses issued shall expire September 30 of each calendar year.
Every landscaper operating within the Township of Nutley shall be required to comply with the following:
A. 
From October 15 through December 15 of each calendar year, all landscapers shall dispose of all leaves at the location and in the manner directed by the Director of Public Works of the Township of Nutley. Dumping tickets must be purchased at the Township Hall, Township of Nutley, Department of Public Works, in advance, according to the following schedule:

B. 
Landscapers shall not be permitted to dispose of sticks, branches, grass clippings, foreign material or construction material at designated municipal sites.
C. 
Landscapers shall be prohibited from placing along any of the public streets, highways, parks or other public place in the township or along any curb for garbage collection, any leaves, sticks, branches, grass clippings, foreign material or construction material. All such materials shall be removed and properly disposed of by all landscapers.

A. 
Upon filing such application shall pay to the Department of Public Works a fee of $50 for two decals. All trucks, vans and trailers must display a decal. Additional decals can be purchased at $15 per decal. Any fraction of the year will be considered a full year for the purpose of this section.
B. 
The terms of such a license shall expire on September 30 of the subsequent year in which such license is issued.
If any person licensed in accordance with the provisions of this chapter shall be convicted of violating any statute, ordinance or regulation in the execution of any work for which a permit is required by applicable ordinance of the Township of Nutley relevant to landscaping, the Township of Nutley shall revoke the license of such person immediately. The Department of Public Works shall not restore such license during such time as the violation for which such conviction was obtained exists or remains.
Any person whose license has been revoked under the provisions above may be relicensed upon approval by the Director of Public Works when the grounds upon which such license was revoked are removed or corrected and upon payment of the fee prescribed herein.
A. 
Any person who violates any provision of this chapter, other than disposal requirements, shall, upon conviction thereof, be punished by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
B. 
Any person who violates the disposal requirements of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $1,000 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
