As used in this chapter, the following terms shall have the meanings indicated:
LOITERING
To stand, sit, lounge or remain idly in essentially one location, or to move slowly about; spending time idly by loafing, lounging, sitting or walking about aimlessly and without purpose.
PUBLIC PLACE
Any place to which the public has access, and includes any street, highway, road, alley or sidewalk. It shall also include the front or the neighborhood of any store, shop, restaurant, tavern or other place of business, and public grounds, areas, parks, as well as parking lots or other vacant private property not owned by or under the control of the person charged with violating this chapter, or in the case of a minor, not owned by or under the control of his parent or guardian.

Any person loitering or standing on the street, sidewalk, curb, highways, roads, alleys or other public grounds, places or building, or on the grounds of a place of business, shall move or withdraw therefrom when required to do so by the police and shall cease to occupy such position if his conduct:
A. 
Is intended to provoke a breach of the peace or may occasion a breach of the peace;
B. 
Is such as to annoy, disturb, interfere with, obstruct or be offensive to others; or
C. 
Warrants alarm for the safety of persons or property in the vicinity.
A person shall be in violation of this chapter if any member or officer of the Police Department of the Township of Nutley has ordered a person to move on who has loitered in a manner enumerated in § 437-2 herein and that person continues to loiter in a manner as enumerated in § 437-2 herein.

Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, forfeit and pay a fine of not more than $500 or be imprisoned in the county jail for not more than 90 days, or both.
