This article is enacted pursuant to and consistent
with the Interlocal Services Act, N.J.S.A. 40:8A-1 et seq.
A.
This article authorizes the Nutley Hazardous Materials
Response Team, as an authorized agent for the Essex County Health
Department under the County Environmental Health Act (CEHA), N.J.S.A.
26:3A2-21 et seq., to receive funds for its response actions.
B.
These funds must be deposited into a dedicated fund
for the express purpose of supporting the Nutley Hazardous Materials
Response Team in carrying out its responsibilities as an authorized
agent under CEHA (N.J.S.A. 26:3A2-35).
C.
This article further provides, as per the contract
with Essex County, to receive funds from any fees, fines and penalties
to the extent authorized under CEHA.
