Whenever a term is used in this chapter which is defined in P.L. 1975, c. 291,[1] such term is intended to have the meaning set forth in the definition of such term found in said statute, unless a contrary intention is clearly expressed from the context of this chapter.

All sections of Chapter 630, Subdivision of Land, Chapter 700, Zoning, Chapter 600, Site Plan Review, or any other ordinance of the Township of Nutley which contain provisions contrary to the provisions of this chapter shall be and are hereby (to the extent of such inconsistency) repealed.
Pursuant to the provisions of P.L. 1975, c. 291, Section 81, the substantive provisions of the existing Chapter 630, Subdivision, Chapter 700, Zoning, and Chapter 600, Site Plan Review, of the Township of Nutley and the development regulations set forth therein shall continue in full force and effect and shall be read in para materia with this chapter.
All applications for development filed prior to the effective date of this chapter may be continued, but any appeals arising out of decisions made on any such application shall be governed by the provisions of Article IV of this chapter.
This chapter shall be known and may be cited as the "Land Use Procedures Ordinance of the Township of Nutley."
Immediately upon adoption of this chapter, the Municipal Clerk shall file a copy of this chapter with the County Planning Board as a required by law. The Clerk shall also file with said County Planning Board copies of all other ordinances of the municipality relating to land use, such as the Subdivision, Zoning and Site Plan Review Ordinances.[1]

A. 
The Board of Commissioners of the Township of Nutley formally and in accordance with N.J.S.A. 40A:12-13(b)(5) approve the agreement to convey a small triangular portion of Baltimore Street right-of-way to TFJ Kingsland LLC in exchange for the paving of the roadway as made a condition of the approval by the Zoning Board of Adjustment on August 21, 2017.
B. 
The Mayor and Clerk are hereby authorized to sign all necessary legal documents and agreements on behalf of the Township of Nutley necessary for the conveyance of a small triangular portion of Baltimore Street right-of-way to TFJ Kingsland, LLC.
