"This ordinance shall take effect immediately after final passage and publication in the manner provided by law with the exception of {original} § 49-2A(3) and 49-2D setting forth the numbers of captains, which section shall take effect on August 31, 2000. Until then, the language of the existing ordinance, as same shall pertain to the number of captains, shall control and shall remain in full force and effect. During the period of time that the department continues to have two captains, the additional captain shall command the Investigations Bureau within the Investigations and Services Division. When the number of captains is reduced to one, command of the Investigations Bureau shall be assumed by the Deputy Chief of Police.
There is hereby created a Police Manpower Council whose purpose shall be to study and report on the rank and manpower needs of the department. The Commission shall consist of seven members, designated as follows: The Director of Public Safety, the Chief of Police, the President of Local 33 of the P.B.A., and four members who shall be appointed by the Director of Public Safety. The members shall serve until the study is complete and the report has been formally submitted to the Board of Commissioners of the Township of Nutley."
There is hereby recognized and established a Police Department in the Township of Nutley, to be known and designated as the "Police Department of the Township of Nutley." The Police Department shall be under the control and in the charge of the Director of the Department of Public Safety as adopted from the membership of the Board of Commissioners, pursuant to New Jersey statutes.

There shall be established within the Police Department the following table of organization:
A. 
Department superior officer complement. The complement of superior officers within the Police Department shall be determined by the Director of Public Safety up to the following:
(1) 
Chief of Police: one.
(2) 
Deputy Chief: one.
(3) 
Police Captains: three.
(4) 
Police Lieutenants: seven.
(5) 
Police Sergeants: 13.
B. 
Department structure. The Department shall be divided into three divisions, a Patrol Division, Investigations Division, and a Services Division.
(1) 
The Patrol Division. The Patrol Division shall consist of three shifts; a day, evening, and night. In addition to the Division Commander, there shall be assigned four Lieutenants, nine Sergeants, and such civilian dispatchers as may be required.
(2) 
The Investigations Division. The Investigations shall consist of the Criminal Investigations Bureau, the Youth Aid Bureau, and the Professional Standards Unit. In addition to the Division Commander, there shall be assigned four Detective sergeants and such Detectives and other officers as may be required, in conformance with policy established by the Director of Public Safety.
(a) 
Criminal Investigations Bureau. The Criminal Investigations Bureau shall consist of a day and evening shift. The hours shall be as established by the Director of Public Safety. The Criminal Investigations Bureau, shall, in addition to investigative responsibilities, develop and implement crime prevention and Neighborhood Watch programs.
(b) 
Youth Aid Bureau. The Youth Aid Bureau shall, in addition to investigative responsibilities, develop and implement programs to deter young people from unlawful conduct and substance abuse. These programs may include, but are not limited to; a Junior Police Academy, Drug Abuse Resistance Education (DARE), School Resource Officers (SRO), and Police Youth Organizations (PYO).
(c) 
Professional Standards Unit. The Professional Standards Unit shall ensure that Department personnel develop and maintain the knowledge, skills, and abilities required for effective performance of their duties through the implementation of a comprehensive, continuous training program. The unit shall also be responsible for the Department's Internal Affairs function.
(3) 
The Services Division. There shall be assigned to the Services Division, such command, supervisory, and other personnel as may be required. The Services Division shall consist of personnel administration, records management, crime analysis, police information technology, facilities and equipment, fleet management, and evidence and property control.
A. 
The Chief of Police shall be the head of the Police Department. The Chief of Police shall be directly responsible to the Director of the Department of Public Safety for the effective and efficient routine day-to-day operations of the Police Department and shall, pursuant to policies established by the Director of the Department of Public Safety:
(1) 
Administer and enforce rules and regulations and special emergency directives for the disposition and discipline of the Police Department and its members, officers and personnel.
(2) 
Have, exercise and discharge the functions, powers and duties of the Police Department.
(3) 
Prescribe the duties and assignments of all subordinates and other personnel.
(4) 
Delegate such authority as may be necessary for the efficient operation of the Police Department to be exercised under his direction and supervision.
(5) 
Report at least monthly to Director of the Department of Public Safety in such form as shall be prescribed on the operation of the Police Department and make such other reports as may be required.
B. 
The Deputy Chief of Police, in fulfilling the duties of the office, shall:
(1) 
Serve as the Acting Chief of Police in the event of the extending absence of the Chief of Police due to illness, disability or suspension.
(2) 
Command the Investigation and Services Division of the Police Department.
(3) 
Coordinate and effectuate the community policing philosophy of the Department.
(4) 
Assume any other duties which may be assigned to the position by the Chief of Police.
C. 
In the absence of the Chief of Police and Deputy Chief of Police, the Chief shall appoint an Acting Chief of Police.
The qualifications for appointments, promotions, removals, discharges and disciplining of any member of the Police Department shall be in accordance with Title 11A and in accordance with other applicable statutes and regulations of the State of New Jersey and the lawful rules and regulations duly adopted by the Director of the Department of Public Safety and the governing body of the Township of Nutley.
The Director of Pubic Safety shall have any and all powers and duties as may be permitted by law under the Commission form of government, including but not limited to the power to make all appointments to and promotions within the Police Department.
The general government and discipline of the Police Department of the Township of Nutley shall be according to the rules and regulations contained in a certain volume entitled "Nutley Police Department — Rules and Regulations." The Chief of Police shall be responsible for the distribution and dissemination of copies of said rules and regulations on file available for the inspection by any and all interested persons. The Director of Public Safety shall be responsible for the administration and enforcement of all said rules and regulations and shall be empowered to delegate the administration and enforcement to the Chief of Police or the superior officer serving as Acting Chief of the Police Department. The Director of Public Safety shall be authorized, empowered and responsible for issuing, promulgating, modifying and amending the rules and regulations.
Any person appointed to a position in the Police Department shall comply with the requirements of all relevant law, including the New Jersey Statutes, with respect to qualifications and training.
