There is hereby established in the Township of Nutley a Shade Tree Advisory Committee.
The Shade Tree Advisory Committee shall consist of five members, all of whom shall be residents of the Township of Nutley.
All members of the Shade Tree Advisory Committee shall be appointed by the Director of Parks and Public Property and shall serve without compensation.
Members shall serve for a term of one year, except that the terms of the initial members shall expire on the third Tuesday of May 1997. If a vacancy in membership shall occur otherwise than by expiration of a term, then such vacancy shall be filled for the unexpired term thereof in the same manner as the original appointment.
A. 
The Shade Tree Advisory Committee shall advise and make recommendations to the Director of Parks and Public Property concerning:
(1) 
Planting maintenance and care of all shade and ornamental trees and shrubbery now located or which may be hereafter planted in any public highway, park or parkway or area between sidewalks and curbs of all public streets within the Township, except those located on county or state highways, parks or parkways.
(2) 
Proper maintenance of the ground surrounding shade and ornamental trees and shrubbery in order to encourage their proper growth, care and protection.
(3) 
The removal of any tree or part thereof which is dangerous to public safety.
(4) 
The care for and control of parks and parkways within the Township and the encouragement of arboriculture within the Township.
(5) 
The administration of treatment to or the removal of any tree situate upon private property which is believed to harbor a disease or insect readily communicable to neighboring healthy trees which may be in the care of the Township.
B. 
The Shade Tree Advisory Committee shall make a written report to the Director of Parks and Public Property on request and at least annually. Such report shall describe the status and overall condition of shade and ornamental trees and shrubbery located along public streets within the Township, parks and parkways within the Township and shall state the Committee's recommendations as to current and future needs for tree purchases, plantings and maintenance in order that the Director of Parks and Public Property may incorporate such information into the municipal budget.
