This chapter shall be known as an "Ordinance
Prohibiting Political Fund-raising on or by Use of Public Property."
The purpose of this chapter is to prohibit political
fund-raising by candidates or elected officials on or by use of public
property.
As used in this chapter, the following terms
shall have the meanings indicated:
CANDIDATE
Any individual seeking election to a public office of the
federal, state, county or municipal government or school district
or political party or political organization.
POLITICAL CONTRIBUTION
All loans and transfers of money or other things of value
to a candidate or elected official.
PUBLIC PROPERTY
All buildings owned or leased by the municipality and shall
include vehicles, phones, fax machines, computers, stationery or municipal
letterhead, postage or other office equipment or supplies owned or
leased by the municipality.
SOLICIT
To request or ask for, by oral or written communication,
a political contribution as same is defined herein.
No elected official or candidate may solicit
or receive payments of, or commitment for payment of any political
contribution while in any public building in the municipality.
No candidate or elected official may solicit
or receive payment of, or commitment for payment of any political
contribution while utilizing public property.
In the event public facilities are made available
to any group for nongovernment use, such as a meeting facility, this
prohibition shall not be deemed to prevent fund-raising
of any sort among members of such groups during the time such groups
have reserved exclusive use of the meeting facility.
Violation of any provision of this chapter shall
be punishable by a period of community service not exceeding 90 days
and/or a fine not exceeding $1,000.
