The smoking or carrying of lighted cigarettes, cigars, pipes
or matches and the use of matches or fire-producing devices in any
retail store in the City in which more than five persons are employed
and actually on duty as clerks at any one time, and in any bus transporting
passengers as a common carrier within the City, is prohibited. However,
the provisions of this article shall not apply to any restaurant room,
rest room, beauty parlor, executive office or any room designated
for smoking in any such retail store.

The provisions of this article are severable and if any of its
provisions or exceptions shall be held illegal, invalid or unconstitutional,
the decision of the court shall not affect or impair any of the remaining
provisions of this article. It is hereby declared to be the legislative
intent that this article would have been adopted if such illegal,
invalid or unconstitutional provisions or exceptions had not been
included herein.

The owner, lessee or operator of such retail store shall post
"No Smoking" signs in not less than five conspicuous places in the
store, and shall be responsible for the enforcement of this regulation.

Any person violating any of the provisions of this article shall
be fined not more than $300 and/or imprisoned not more than 90 days.
