A. 
No employee, elected official or appointed member of a board of the City of Perth Amboy may accept any gratuity, gift, item or service of monetary value from a vendor, prospective vendor or party to a contract with the City of Perth Amboy or any of its boards or agencies.
B. 
No employee, elected official or appointed member of a board of the City of Perth Amboy may accept any gift, gratuity, item or service of monetary value from a resident or business person in the City of Perth Amboy in consideration for the performance of his or her municipal duties or because of his or her status as a municipal official or employee.
C. 
No employee, elected official or appointed member of a board of the City of Perth Amboy shall accept any discounted merchandise, services, or other item of value from a resident or business person in the City of Perth Amboy in consideration for the performance of his or her municipal duties because of his or her status as a municipal official or employee.
D. 
No vendor, prospective vendor or party to a contract with the City of Perth Amboy or any of its boards or agencies shall offer or give any gratuity, gift, item or service of monetary value to any employee in consideration for the performance of his or her municipal duties or to an elected official or appointed member of a board of the City of Perth Amboy because of his or her status as a municipal official or employee.
E. 
No resident or business person in the City of Perth Amboy shall give any gift, gratuity, item or service of monetary value, or provide any discounted services or merchandise to an employee in consideration for the performance of his or her municipal duties or to an elected official or appointed member of a board of the City of Perth Amboy because of his or her status as a municipal official or employee.
A. 
This Article is not intended to prohibit municipal employees or officials from exchanging birthday and holiday gifts having a value of not more than twenty-five dollars ($25).
B. 
This Article is not intended to prohibit elected or appointed city officials or city employees from attending free of charge not-for-profit, educational, charitable, government-sponsored or religious events where the City official or employee is invited by the sponsoring entity in his or her official capacity as a representative of the city, as an honoree or as a participant in a workshop, seminar or other educational program related to his or her municipal duties. This exclusion does not apply to political events, or to events that are sponsored by, or the official's attendance paid-for by, a vendor or prospective vendor to the city, any of its boards or authorities.
C. 
Disclosure form. Every City official, board member or employee who attends an event described as free-of-charge, or at reduced cost, shall file a written disclosure with the Municipal Clerk describing the event, the sponsoring entity and the monetary value of the event. The Disclosure Form shall be filed within seven (7) days of attendance on a standard form available in the Clerk's office and it shall be available for public inspection. Employees of the city shall also provide a copy of the Disclosure Form to his or her department head.
Any person, firm or corporation who shall violate any of the provisions of this Article shall, upon conviction, be punished by a fine not to exceed five hundred dollars ($500) or by imprisonment in the county jail for a period not to exceed ninety (90) days, or both. An employee who is convicted of a violation of this Article shall also be subject to disciplinary action by the City Administration. A contractor or prospective vendor who is convicted of a violation of this Article shall also be subject to termination of its contract and/or debarment from contracting with the City of Perth Amboy for a period of two (2) years by action of the City Council.
