The provisions of this chapter shall be administered by the
Department of Human Services, Division of Vital Statistics.

Whenever used in this chapter, unless a different meaning clearly
appears from the context, the following definitions shall apply:
FOOD
Any raw, cooked or processed edible substances, water, ice,
beverage or ingredient used or intended for use or for sale, in whole
or in part, for human consumption.
FOOD ESTABLISHMENTS (other than public eating places)
Any establishment, however designated, other than public
eating places, regularly and principally used for the preparing, manufacturing,
cooking, processing, storing, distributing, transferring, selling
or consuming of food and/or nonalcoholic beverages.
PUBLIC EATING ESTABLISHMENT
Any establishment, however designated, regularly and principally
used for the preparing, cooking and serving of foods, for which seating
on the premises is provided, for public consumption.

A. The license fees for the licensing of food establishments shall be
in accordance with the following table. Permits shall expire and shall
be renewed as prescribed below:

B. Reinspection and plan review fees.
(1) Retail food establishment reinspections fee: $25.
(2) Retail food establishment initial plan review fee: $75.
(3) Fees are payable to the Middlesex County Public Health Department
within ten (10) business days of the reinspection or plan review.
(4) Failure to pay the fee within ten (10) working days will result in
a court summons with fines as follows:

The fees and any subsequent court costs will be in addition
to the fines provided above for anyone found guilty of violation of
this section.

A food service establishment may be licensed for any combination
of the above but shall only be charged for the highest fee.

A. Failure to pay the yearly fee by January 30: $100.
B. Failure to pay the yearly fee by March 31: $500.
In addition to any other penalty provided by other sections
of this chapter, any person, firm or corporation who shall violate
any of the provisions of this chapter shall, upon conviction, be punished
by a fine not less than $100 and not more than $1,000 or by imprisonment
in the county jail for a period not to exceed 90 days, or by both
such fine and imprisonment, and each violation of any of the provisions
of this chapter and each day the same is violated shall be deemed
and taken to be a separate and distinct offense.
