Any individual, property owner, business entity or corporation who or which shall violate any of the provisions of this chapter, shall, upon conviction, be punished by one or more of the following: imprisonment in the county jail or in any place provided by the municipality for the detention of prisons for any term not exceeding 90 days or by a fine not exceeding $1,000 or by a period of community service not exceeding 90 days; and each violation of any of the provisions of this chapter and each day the same is violated shall be deemed and taken to be a separate and distinct offense. Conviction for violation of § 243-2, Unlawful dumping or disposal; Prohibited acts and regulated activities, shall result in a fine for the first offense of not less than $500 and not more than $2,000.
In addition, the court may order payment of restitution to the
City of Perth Amboy for costs incurred in remediating any violation.
The Director of Public Works, the Municipal Recycling Coordinator,
the Department of Code Enforcement, the Director's designees, all
sanitation inspectors, and all City of Perth Amboy police officers
are authorized to issue summons for violation of any and all provisions
of this chapter.
