As used in this chapter, the following terms shall have the meanings indicated:
ALUMINUM CANS
Food and beverage containers made entirely of aluminum.
AUTHORITY
The Middlesex County Improvement Authority, a public body corporate and politic of the State of New Jersey, organized by the County pursuant to the County Improvement Authorities Law (N.J.S.A. 40:37A-44 et seq.).
AUTOMATED COLLECTION
The use of a city issued ninety-five (95) gallon container for automated vehicle pickup.

AUTOMATED CONTAINER
A city issued ninety-five (95) gallon plastic blue cart specifically designed for automated collection of recyclables and having a serial number(s) assigned specific to each address receiving automated collection.

BOARD
The Board of Chosen Freeholders of the County of Middlesex, New Jersey.
BRUSH
Branches, woody plants and other like vegetative material that do not exceed five (5) inches in diameter and Christmas trees. "Brush" does not include leaves and grass clippings.
COMMINGLED CONTAINERS
Twenty-gallon (20) plastic containers to be used by the residents to place plastic containers, glass containers, aluminum cans and steel cans at the curb for collection or such other container designated by the Authority for such use.
CORRUGATED CARDBOARD
Boxes and packaging generally made from wood pulp and consisting of two (2) smooth sides with a corrugated inner layer. Brown paper grocery bags are included.
COUNTY PLAN
The Middlesex County District Solid Waste Management Plan, adopted by the Board pursuant to the Solid Waste Management Act,[1] which provides for the collection, disposal and/or recycling of solid waste generated with the geographic boundaries of the county, as the same may be amended from time to time.
COUNTY-WIDE RECYCLING PROGRAM
The collection and marketing program for Authority-collected recyclables established by the county and the Authority for all participating municipalities in the county and funded, in part, with RRIT Funds allocated for this purpose.
DESIGNATED RECYCLABLE MATERIALS
All recyclable materials that are designated by the county in the county plan as materials that must be source-separated from municipal solid waste at the point of generation.
GLASS CONTAINERS
All glass containers used for packaging food or beverages.
HIGH-GRADE OFFICE PAPER
Includes fine paper, bond paper, offset paper, xerographic paper, mimeograph paper, duplicator paper and related types of cellulosic materials containing not more than ten percent (10%), by weight or volume, of noncellulosic materials, such as laminates, binders, coatings or saturants.
MIXED PAPER
Glossy inserts, magazines, telephone books, junk mail, color paper, computer paper, office paper, paper board (chip board and press board) nonmetallic wrapping paper, soft cover books, hard cover books with covers removed and fine paper.

MIXED PAPER CONTAINER
A covered fourteen-gallon container in which residents will place mixed paper at the curb for collection or such other container designated by the Authority for such purpose.
MOTOR OIL
A petroleum based or synthetic oil whose use includes, but is not limited to, lubrication of internal combustion engines which, through use, storage or handling, has become unsuitable for its original purpose due to the presence of impurities or loss of original properties.
MUNICIPAL SOLID WASTE
I.D. Type 10 waste, as defined by N.J.A.C. 7:26 - 2.13(g)(1)(i).
MUNICIPALITY
The City of Perth Amboy, a municipal corporation of the State of New Jersey.
NEWSPAPER
Paper of the type commonly referred to as "newsprint" and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest.
PLASTIC CONTAINERS
Soda bottles made of PETE (SPI Code No. 1) and milk, water and laundry product bottles made of HDPE (SPI Code No. 2).
RECYCLABLE MATERIALS
Those materials which would otherwise become municipal solid waste and which may be collected, separated or processed and returned to the economic mainstream in the form of raw materials or products.
RECYCLING
Any process by which materials which would otherwise become solid waste are collected, separated or processed and returned to the economic mainstream in the form of raw materials or products.
SINGLE STREAM RECYCLING
Combining all aluminum cans, glass bottles, plastic bottles, newspaper, mixed paper and cardboard products as defined in this section into a container weighing no more than fifty (50) pounds or into one (1) ninety-five (95) gallon blue container where automated collection occurs.

STEEL CANS
Tin-plated, bimetal and other ferrous food and beverage containers.
TEXTILES
Clean, dry clothing or other fabric measuring at least one by one (1 x 1) foot in size.

The following material must be separated from the solid waste generated within the City of Perth Amboy at the point of generation for separate collection.
A. 
Newspapers. Newspapers shall be placed at curbside for collection by the city.
B. 
Mixed paper (magazines, office paper, junk mail, telephone books, file folders, cereal boxes with plastic removed, shoe boxes, game board boxes, books with hard covers removed, craft paper, envelopes, non-foil wrapping paper, scrap paper). Mixed paper shall be placed at curbside for collection by the city.
C. 
Corrugated cardboard. Corrugated cardboard shall be placed at curbside for collection by the city.
D. 
Commingled mix (steel, tin and aluminum food and drink cans, glass and plastic food and beverage containers). Commingled mix shall be placed at curbside for collection by the city.
E. 
Textiles. The city will not collect textiles at curbside. Residents must deliver textiles to the Department of Public Works.
F. 
Brush. Residents must deliver brush to the Department of Public Works or schedule an appointment with the Department of Public Works for pickup. The city will collect Christmas trees at curbside during the first two (2) weeks of January only.
G. 
Leaves. The City of Perth Amboy will collect leaves at curbside from October 31 through December 31 only. During the remaining months, residents must deliver leaves to the Department of Public Works. Leaves must be raked and bagged in brown biodegradable bags that are supplied by the City of Perth Amboy. At no time will raking leaves into the roadway be permitted.
H. 
Motor oil. The city will not collect motor oil at curbside. Residents must deliver motor oil to the Department of Public Works.
I. 
Cooking oil. All commercial establishments which prepare food for consumption shall be required to recycle all used cooking oil. The city will not collect cooking oil at curbside or at the Department of Public Works. Establishments may obtain a list of approved recyclers from the city's Recycling Division.
J. 
For residential (including multifamily), commercial, industrial and institutional, governments and office parks:
(1) 
Masonry/paving material: Asphalt, block, brick, cinder, and concrete. The city will not collect masonry/paving material at curbside or at the Department of Public Works. Please contact an approved recycler.
(2) 
Rechargeable batteries: Nickel Cadmium (Ni-Cd), Nickel Metal Hydride (Ni-MH), Lithium Ion (Li-ion) and Small Sealed Lead (Pb). The city will not collect rechargeable batteries at curbside. Rechargeable batteries must be delivered to the Department of Public Works.
(3) 
Tires: Rubber-based scrap automotive, truck, and equipment. The city will not collect tires at curbside or at the Department of Public Works. Residents must deliver tires to the Middlesex County drop off facility located at 225 Smith Street, Keasbey, N.J. or contact another approved recycler.
(4) 
White goods: Washers, dryers, ranges, refrigerators, air conditioners: Note: all devices that contain CFCs must be properly evacuated by licensed individuals and all CFSs recovered must be sent to an EPA approved reclaimer. Residents must deliver white goods to the Department of Public Works or schedule an appointment for pickup with the Department of Public Works in accordance with Section 243-3 (B) of Chapter 243.
K. 
For commercial, industrial and institutional, governments and office parks: The city will not collect the following materials at curbside or at the Department of Public Works. Materials listed in Subsections K(1)-K(4) must be delivered to an approved recycler. By January 15th of each year, all commercial, industrial, institutional, governments, and office parks must provide the city's Recycling Division with documentation of all materials listed in Subsections K(1)-K(4) that were recycled in the previous calendar year.
(1) 
Electronics: Televisions, CPU's, monitors, laptops, and mercury containing devices
(2) 
Fluorescent bulbs: Lamps that contain mercury
(3) 
Plastic film: Stretch/shrink wrap, plastic shopping bags - only for warehouses, retail establishments and supermarkets with twenty-five (25) or more employees
(4) 
Wood scrap: Unfinished lumber from new construction projects including pallets. Unfinished shall mean nonchemically treated (not pressure treated, impregnated with preservatives, insecticides, fungicides, creosote, or other chemicals, and not painted, resin-coated or otherwise surface treated, and not laminated or bonded; and not similarly altered from its natural condition) - only for new construction sites.

The Director of Public Works is hereby authorized and directed to establish and promulgate regulations as to the manner, days and times of collection for all the materials identified in Section 351-2 and the bundling, handling, location and time of placement of said recyclable materials.
A. 
The City of Perth Amboy, through its Department of Public Works, shall develop and implement a recycling plan consistent with the Middlesex County Recycling Plan, which plan shall include curbside collection services for residences in the City of Perth Amboy of newspapers, mixed paper, glass bottles, plastic containers, aluminum, steel and tin cans and corrugated cardboard.
B. 
The City of Perth Amboy recycling plan shall provide for drop-off services for all other recyclable materials identified in Section 351-2.
All premises within the City of Perth Amboy shall be required to recycle all materials designated as recyclable materials in this chapter. However, premises may provide for the recycling of recyclable materials through the use of authorized solid waste collection contractors if the premises provides the Recycling Coordinator with a quarterly report that both outlines the operation of the private recycling programs and provides documentation for the total weight of each material recycled in accordance with the schedule contained in the rules and regulations promulgated by the Director of Public Works.

A. 
The recyclable materials identified in Section 351-2 above shall be kept separate from and not mixed with regular refuse which is collected by the Department of Public Works. The residential, commercial, business and institutional sectors of the city shall be responsible for the separating of items as listed in Section 351-2 above.
B. 
Newspapers shall be considered clean and uncontaminated if they have not been exposed to substances or conditions rendering them unusable for recycling. Persons may wrap refuse in used newspapers and discard the same with regular refuse to the extent necessary to properly dispose of said refuse.
C. 
Glass bottles, plastic containers and aluminum, steel and tin cans shall be rinsed prior to placement for collection.
D. 
Recyclable materials shall be placed at curbside no sooner than one (1) hour before sunset of the day prior to the scheduled pickup and empty containers shall be removed by 8:00 p.m. of the day of collection.
E. 
Recyclables not picked up due to improper preparation, snow, or other emergency shall be removed from curbside by 8:00 p.m. of the day of collection.
F. 
Effective December 1, 2012, glass, cans, paper and cardboard can be combined for once per week pickup referred to as single stream.

A. 
From the time of placement at the curb by any person of any recyclable material for collection by the City of Perth Amboy pursuant to the mandatory recycling program established hereby and the rules and regulations established hereunder, such materials shall become and be the property of the City of Perth Amboy, and it shall be a violation of the chapter for any person other than authorized personnel of the Department of Public Works to collect, pick up or cause to be collected or picked up such recyclable materials. Each such collection in violation hereof from each location shall constitute a separate and distinct offense.
B. 
Any resident, commercial business or institution may donate or sell recyclable material to any person, partnership or corporation for proper disposal as recyclable material. Said person, partnership or corporation will not, however, under any circumstances, pick up or collect said recyclable material from the curbside within the City of Perth Amboy.
C. 
The prohibition of scavenging set forth in this section shall not include not-for-profit corporations which have been specifically permitted by the City of Perth Amboy to scavenge certain designated recyclables.
A. 
All solid waste haulers and authorized scavengers which are involved with recycling within the City of Perth Amboy shall register with the Recycling Coordinator within forty-five (45) days of the effective date of this chapter and by April 15 of each calendar year hereafter.
B. 
All persons or entities which are required to register with the Recycling Coordinator shall provide the Recycling Coordinator with such information concerning materials and quantities recycled as may be required by the Director of Public Works or the Recycling Coordinator. The reporting of said information shall be in accordance with the rules and regulations promulgated by the Director of Public Works.
The Department of Public Works, the Police Department and the Recycling Coordinator are hereby empowered to enforce this chapter and the rules and regulations promulgated thereunder.
Any person, firm or corporation who or which violates or neglects to comply with any provision of this chapter or any rule or regulation promulgated pursuant thereto shall, upon conviction thereof, be punishable by a fine not less than one hundred dollars ($100) and not to exceed one thousand dollars ($1,000). If the violation is of a continuing nature, each day during which it continues shall constitute an additional, separate and distinct offense.

At the time of issuance of any building permit, the Building Code Official will provide written instruction on proper disposal and recycling of construction and demolition waste and furnish a Notification of Construction/Demolition Activity Form that must be filled out by the permittee and faxed to the Middlesex County Division of Solid Waste Management (MCDSWM) within forty-eight (48) hours of the issuance of a municipal permit.
A. 
Residential. Each major application for residential development shall include provisions for the collection, deposition, and recycling of recyclable materials and refuse.
Each multifamily complex must provide bins in a convenient location or locations in a common area as drop-offs for storing refuse and recyclables until collection occurs.
The holding area shall provide for truck access and loading, shall be suitably screened from view, and set back from property lines. The screening shall include a solid wall and evergreen vegetation equal to or greater than the height of the storage receptacles.
B. 
Nonresidential.
(1) 
Each application for a nonresidential use which utilizes one thousand (1,000) square feet or more of land shall include provisions for the collection, disposition and recycling of recyclable materials and refuse. The applicant shall provide a screened storage area. The storage area shall be designed for truck access for pickup of materials and shall be suitably screened from view if located outside a building by a solid wall and evergreen vegetation equal to or greater than the height of the storage receptacles.
(2) 
All nonresidential uses shall provide a screened area for the storage of pallets, trash and recyclable materials.

Effective March 11, 2013, all recyclable items authorized for automated collection shall only be placed in the city issued ninety-five (95) gallon blue cart. Recyclable items will be collected using a single stream method as defined in this chapter. Excluded types of waste include household garbage, hazardous waste, bulky waste and vegetative waste.
