Definitions. As used in this chapter, the following terms shall have
the meanings indicated:
BEAUTY CULTURE (COSMETOLOGY AND HAIRSTYLING)
Any place, any establishment, or any premises wherein any
one or any combination of the following practices is done on the human
body for cosmetic purposes and not for the treatment of disease or
physical or mental ailments, when done for payment, either directly
or indirectly, or without payment, for the general public: Providing
personal services such as:

A.
Shaving, clipping, trimming of the beard, mustache, facial,
neck or other body part hair;
B.
Shampooing, conditioning, cutting, arranging, dressing, relaxing,
curling, permanent waving, or styling of the hair;
C.
Singeing, dyeing, tinting, coloring, bleaching of the hair;
D.
Hair-weaving, hair extensions, threading, hair replacement to
the extent that the procedure does not involve the replacement of
human hair by means of the insertion of any natural or synthetic fiber
hair into the scalp;
E.
Cutting, fitting, coloring or styling of hairpieces or wigs,
to the extent that the services are performed while a person would
be wearing the piece;
F.
Applying cosmetic preparations, antiseptics, tonics, lotions,
creams or makeup to the scalp, face or neck; massaging, cleansing
or stimulating the face, neck or upper part of the body, with or without
cosmetic preparations, either by hand, mechanical or electrical appliances;
G.
Removing superfluous hair from the face, neck, arms, legs, or
abdomen by the use of depilatories, waxing, or tweezing, but not by
the use of electrolysis;
H.
Manicuring of the fingernails, nail-sculpting, or pedicuring
of the toenails
BUTCHER
Includes whoever is engaged in the business of keeping, driving
or slaughtering any cattle, or any person engaged in the preparation
of meat for food purposes.
CATTLE
Includes the living animals of the bovine family of the animal
kingdom, or all animals, except birds, fowl and fish, of which any
part of the body is used as food.
CELLAR
Means and includes every basement or lower story of any building
or house of which one-half (1/2) or more of the height from the floor
to the ceiling is below the level of the street adjoining.
CONTAGIOUS DISEASE or COMMUNICABLE DISEASE
Includes any disease of an infectious, contagious or pestilential
nature with which any person may be sick, infected, affected or attacked
(more especially, however, referring to cholera, yellow fever, smallpox,
diphtheria, ship or typhus, typhoid and scarlet fevers), and also
includes any new diseases of an infectious, contagious or pestilential
nature and also any other disease publicly declared by the Division
to be dangerous to the public health.
DIRT
Natural soil, earth and stone.
FISH
Includes every part of the carcass of an animal that inhabits
water or the flesh of which is not meat.
FOOD
Includes every article used for food or drink by man and
every ingredient in such article and all confectionery.
GARBAGE
Includes any offal, refuse animal or vegetable matter, any
accumulation of animal or vegetable matter, or both, liquid or otherwise,
that attends the preparation, decay, dealing in or storage of meats,
fish, fowl, birds, fruits or vegetables.
MEAT
Includes every part of every herbivorous animal and eggs
(whether mixed or not with any other substance).
PERMIT
The permission in writing of the Division of Health, issued
according to its rules and regulations and this chapter.
PERSON
Imports both the singular and plural, as the case demands,
and includes individuals, corporations, companies, societies and associations.
When construing and enforcing the provisions of this chapter, the
act, omission or failure of any employee, officer, agent or other
person acting for or employed by any individual, corporation, company,
society or association within the scope of his employment or office
shall in every case also be deemed to be the act, omission or failure
of such individual, corporation, company, society or association as
well as that of the person.
PRIVATE MARKET
Includes every store, cellar, stand and place (not being
a part of a public market) at which the business is the buying, selling
or keeping for sale of meat, milk, fish or vegetables for human food.
PUBLIC PLACES
Includes parks, piers, docks and wharves, and water and open
spaces thereto adjacent, and also public yards, grounds and areas
and all open spaces between buildings and streets.
REGULATIONS
Includes special regulations which will be from time to time
issued and will contain more detailed provisions than can be herein
conveniently set forth.
RUBBISH
Includes all the loose and decayed material and dirt-like
substance that attends use and decay or which accumulates from buildings,
storing or cleaning.
STREET
Includes avenues, sidewalks, gutters, places and public alleys.
TENEMENT HOUSE
Means and includes every house, building or every portion
thereof which is rented, leased, let or hired out to be occupied or
is occupied as the house, home or residence of more than two (2) families
living independently of one another and doing their cooking upon the
premises, or by more than two (2) families upon a floor so living
and cooking, but having a common right to the halls, stairways, yards,
water closets or privies, or some of them.
VEGETABLE
Includes specie of plant life that can be used as food in
the diet of man and also every article of human consumption as food
which (not being meat or fish or milk) is held or offered or intended
for sale or consumption.
